According to Article II, Sec. 2, the President may grant "reprieves and pardons for offences against the United States, except in cases of impeachment."

There is no exception for treason. The question which has not yet been resolved is whether a President can pardon himself.

If Biden resigns, he will be safe as long as the DOJ is in Democrat hands, and even if Trump wins, a trial would be held in DC, so the jurors would all be Democrats.
