Manhattan DA won't oppose Trump request to file motion arguing conviction should be tossed

NEW YORK (WABC) -- The Manhattan district attorney's office said Tuesday it would not oppose former President Trump's request to file a motion arguing his conviction should be tossed, a move that will almost certainly delay Trump's sentencing, which is currently set for July 11.

"Although we believe defendant's arguments to be without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion," assistant district attorney Josh Steinglass wrote in a letter to Judge Juan Merchan.

I think they just assumed Trump would appeal and easily win. But the impact would be what they wanted - him having a criminal felony conviction hanging over him during the election. What happened afterward was not their concern.

But too much of the country knows lawfare when they see it. It backfired.

They only need the “convicted felon” label until the election. They don’t give a rats behind about this case as long as it gets the FJB regime reinstalled . . .

I think they’re calculating the over-and-under on leaving Trump as a “convicted felon” with a suspended sentence vs the backlash that would result from sentencing him to jail time.

This has always been a political prosecution, everything has been to maximize political damage to Trump’s candidacy.

Guarantee that polls and political consultants will have a bigger impact than legal scholars.

It's not his decision if Trump does file a motion. And it's not his job to claim Trump's arguments have no merit. That's a Judge's job. Alvin must be trying out for a Judgeship.

There was a Supreme Court decision last week that ruled that jury guilty convictions must be unanimous

Central to the Trump prosecution was the Judges jury instruction that the jury could pick from a list of “criminal” acts Trump purportedly committed and that they did not need to come to a unanimous decision on the specific crime.

The Judges jury instructions were blatantly unconstitutional . They violated President Trump's rights to due process and the entire case will be overturned. I'm pretty sure that not even the most biased NY appellate court would dare go against that ruling.

I don’t see how the NY case would be affected by the immunity ruling. It all happened before he was president.

But holding off sentencing until after the R convention may be a good move. It will allow the judge to do the most damage with his sentence. He will be able to adjust the sentence depending on whether the D’s drop Biden and if so, for whom.

The point of this trial was to interfere with Trump’s reelection. He will do whatever is needed to maximize that effect.

They got their catch fraise "Convicted Felon". I doubt they expect millions to flat out say they were "Voting For the Convicted Felon".

Their hopes of using it to attack Trump died a quick death.
