Oakland man, 77, is arrested for murder after shooting dead one member of burglary gang who broke into his home wielding crowbar

A 77-year-old Oakland man has been arrested after he shot and killed a suspected burglar.

Police say two men and a woman pulled up outside the man's home in a stolen vehicle on Monday evening.

One suspect was allegedly holding a crowbar as the three headed inside the man's home, as reported by KTVU.

The homeowner, who has not been publicly named, apparently shot one of the men, the woman in the group told officials.

He was pointing the gun at the woman when police arrived, per officials.

The third suspect was found at the scene with a replica gun and was arrested on suspicion of burglary.

The homeowner has been detained on suspicion of murder while the Alameda County District Attorney's Office considers whether to file charges.

Police say the weapon used by the homeowner, a Colt Python revolver, was stolen.

Prosecutors have until Thursday to decide whether they will charge the homeowner, who has reportedly declined speaking with detectives.

This was posted earlier, but this is a better article with more information. It says the homeowner was wounded in the foot in a shootout apparently with the suspect who was killed. It says the surviving suspects have been charged with felony murder. The homeowner refused to talk with police. He is in jail, but they haven't charged him with anything yet.

I’m suspecting the charge has to do with the gun homeowner used being allegedly stolen.

In a sane world, he’d be exonerated in shooting the burglar, but the stolen firearm is going to be a big problem for him.

I bought my Colt Python at a gun show in 1996. It was preciously owned by an abortion doctor who had death threats against him and decided to give up the practice and sold the gun. I recently had an offer to sell it for 10 times what I paid for it. NO WAY.

“The homeowner has been detained on suspicion of murder while the Alameda County District Attorney’s Office considers whether to file charges.” If he has NOT been charged, but has been detained, then the headline is grossly wrong and misleading.
