Justices Sotomayor and Kagan must retire now
Vox ^ | 6/10/24 | Ian Millhiser

Posted on 06/12/2024 3:22:32 AM PDT by cotton1706

Let’s not beat around the bush. It is more likely than not that Donald Trump will return to the White House next year. Right now, polling averages show Trump with a slight popular vote lead over incumbent President Joe Biden. And, even if Biden overcomes this small deficit, the Electoral College system effectively makes Trump votes count more than Biden votes.

Although there may be signs that the Republican Party’s advantage in the Electoral College is fading, that advantage was substantial in the last two presidential elections. Democrat Hillary Clinton beat Trump in 2016 by more than two points in the popular vote, but still lost the Electoral College. Biden beat Trump by more than four points, but would have lost if a small number of votes had flipped to Trump in a handful of states.

That means that, if Justices Sonia Sotomayor or Elena Kagan remain on the Supreme Court past this year, they risk allowing their seat to be filled by a convicted felon who tried to overthrow the duly elected government of the United States of America, inciting an insurrection at the United States Capitol in the process.

The full picture for liberals on the Supreme Court is even grimmer. It is still possible that Biden will prevail this November — polls fairly consistently suggest that the most engaged voters prefer the incumbent — but Democrats need a miracle to keep their majority in the malapportioned United States Senate.

Senate malapportionment is such a liability for Democrats that Republicans would not have controlled the Senate at all since the late 1990s if Senate seats were distributed fairly based on population.

Boy they hit all the talking points in this piece.

They're getting VERY worried.

They've thrown 87 kitchen sinks at Trump, everything they could think of, and he's still standing.

They're SO used to easily vanquishing pantywaist Republican opponents.

Not this time. Not this guy.

Senate seats have nothing to do with population. Senators represent the State. Why I believe the 17th Amendment should be overturned.

This blithering bastitch has no comprehension whatsoever of the Constitution and the Republican government it established.

Apportioning the Senate by population? As if the Seventeenth Amendment wasn't disastrous enough...

“malapportioned” Senate? Its completely fairly apportioned. 2 Senators for each state.

The US is a federation of states, not of individuals. States elect presidents, not individuals.

Without the Connecticut Compromise, smaller states had absolutely no incentive whatsoever to ratify the US Constitution and join the US. Now Leftists want to go back on the deal......but they don’t want any state to secede. God no! Some people somewhere might maybe be able to escape their dream of totalitarian control over every last aspect of their lives??? The horror!!!

No. No. They don’t need to retire, yet.

They haven’t considered one element. Liberal hubris. Does anyone think these liberal ‘justices’ will willingly give up their claim to fame while breath is still coursing in them? RGB wouldn’t. If there is one more chance for them to pontificate, emote, bloviate and feign relevance, they will hang on to their robes like Biden to his pudding cup.

Nothing like that. DT is the most likely world leader to be assinaated. It would be bad enough if it was just Hamas and Ukraine, Biden's paymasters, but the biggest risk comes from our own deep state.

If DT lives to serve I will be more surprised that any time in my long life of observation of these things.

“Democrat Hillary Clinton beat Trump in 2016 by more than two points in the popular vote, but still lost the Electoral College.”

Hillary won the popular vote only because she won California by four million votes. Take that away and she not only gets hammered in the EC, she loses the irrelevant popular vote also.

Well stated. Every Deep State every liberal Dem, every Never Trump Rino really believed that lawfare would be the stake in Trumps heart. All it did was make him stronger and increase his voting base.

My favorite lament is Trump will exact revenge! No. He wont. He will clean house and see that justice, true justice rules the day. Steve Bannon was on Tucker Carlson and had an interesting comment about the 51 who signed the Hunter Biden lap top Russia Disinformation letter. He, paraphrasing, said, “Go ahead and run. Flee the country next November. There is a process called extradition.”.

AMEN!

I don`t know much about the US Constitution (I`m German), so honest question: If the US is a federation of states why are states not allowed to secede? Wasn`t that what the Civil War was about? If the states can`t do that the whole federation thing seems to be more of theoretical concept. In that case you might as well end it and acknowledge that you are one state, even if that`s maybe not how you started out.

I'm no constitutional expert but I don't think that it forbids a state to secede. Just think back to recent referendums in Scotland and Quebec.

Some years ago (can't recall exactly when) there was a referendum in Quebec (Canada) asking voters if Quebec should break away from the rest of Canada and become a sovereign country. It failed. There was no indication that if it succeeded that Canada would send troops into Quebec.

And then there's Scotland. A few years ago (2014?) there was a similar referendum there. It failed. Again, there was no indication that London would have sent troops into Scotland if it had succeeded.

I strongly doubt that any state...or group of states...that wanted to break away would be forced to stay through the use of troops or anything like that.

Senators represent the State. Why I believe the 17th Amendment should be overturned.

That was the idea at least. The state legislatures who used to elect the senators were composed of members from the entire state. The way it is now, a senator from a state like NY basically represents NYC only.

"Let’s not beat around the bush. It is more likely than not that Donald Trump will return to the White House next year."

I pray this to be true and accurate, but I fear the money of Soros, Klaus Schwab, Suckerburg and other "one world scum" will make the cheat insurmountable..

Trump won the last one, and look where we are now.... :(

They are allowed to secede, but only with mutual agreement with the federal government and the people affected.

Same is true with Scotland and the UK

Same would be true of a German state

The dems like to bring up the fact their losing candidates got more popular votes than the Republican victor. What is always left unsaid is all those “extra” popular votes are from the most corrupted election locales (dem controlled large cities).
