Judge Aileen Cannon rips up court schedule in Mar-a-Lago case in ways that benefit Trump

Judge Aileen Cannon is again ripping up the court schedule in former President Donald Trump’s classified documents case – pushing some of the legal questions that have been before her for months even further down the road.

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority.

The planned hearing also adds a new, unusual twist in the federal criminal case against the former president: Cannon on Tuesday said that a variety of political partisans and constitutional scholars not otherwise involved with the case can join in the oral arguments later this month.

It’s an extraordinary elevation of arguments in a criminal case – filed a year ago this week – that likely won’t see trial until next year, if at all.

Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue.

Cannon will hear arguments on those issues the week of June 21, as well as on the effort by Trump to throw out evidence in his case that was gathered by the FBI in its 2022 search of Mar-a-Lago or provided by his former attorney Evan Corcoran to a grand jury.

At the same time, she delayed other hearings without setting a new date.

The calendar shuffling is the latest example of Cannon’s approach so far to the national security case: scheduling hours in court for arguments that other courts have mostly denied, and pushing off resolution of various legal matters for months.

I look for Cannon to delay decisions until shortly before the election, and they will be favorable to Trump.

Smith was not nominated and confirmed by Congress, so he is an illegal prosecutor.

Case closed.

Cannon is doing what judges normally do.

Listen to both sides and hear the arguments.

Dancing to the DOJ music is not the normal case.

That would have rendered him appropriately subject to impeachment. As things stand now he’s immune to impeachment!

It’s not the “court schedule”, it’s Judge Cannon’s schedule. The judge sets the calendar and notifies the clerk of pertinent dates relating to a case. I’ve never known a judge to ask “the court” for permission to schedule a hearing or the correct date to schedule responsive pleadings.

A judge may consult with the parties regarding conflicts, and adhere to laws about required time frames, but the judge is the keeper of their chamber’s calendar. The parties can suggest preferred dates but the DOJ doesn’t get to tell the judge what dates she must pick and when to schedule a hearing.

CNN’s articles makes it seem like someone other than the judge is in charge of calendaring issues.

Jack Smith is used to DC courts where he makes the rules and the judges go along with him. To his dismay, Jack Smith is not in a DC courtroom.

It would be unethical for Judge Cannon to refuse allowing a hearing on so central a matter considering what is at stake for the defendant.

This is BS.

ALL of these cases against Trump are proceeding at warp speed for our legal system.

It is normal for complex cases to go on for years before going to trial so if justice were the goal no problem

But the Democrats need to rail road Trump by the November election

Judge Cannon is being very smart. While she sees the Jack Smith dirty tricks - tricks a liberal judge might look the other way - she is carefully taking the time to listen to arguments and to carefully consider all legal issues -- IOW, she is delaying the trial past the time of the election!

Normally that would be considered reasonable conduct by a careful judge. The problem is that Jack Smith, Jay Bratt, Merrick Lavrentiy Beria Garland and Genghis Joe Bitem want a quick outcome in order to eliminate their most imposing political candidate threat.

Consequently the autocratic govt organs are raising petitions to get the judge removed from the case and their boot licking Pravda media to scream judicial incompetence. Their chances of success - prior to the election - would be better playing the super powerball lottery!

If Cannon rules that Smith’s appointment was illegal and dismisses the Florida case against Trump, how does that impact the DC J6 case?

A REAL judge who realizes that the case goes far beyond the issues at hand.....she is recognizing the left's lawfare and wants various ideas about it on the record.Malicious prosecution is about to be declared! Violation of President Trump's civil rights! She looks the lefty fascists in the eye and does not blink.

Justice Cannon will one day be on the Supreme Court of the United States.
