Disciplined judge responds “We’re not swingers” following Colorado investigation

COLORADO (KCNC) — A Colorado judge who accepted a public censure and resigned following accusations of sexually charged conduct at work is striking back at the state investigation into his behavior calling it “disproportionate punishment for the crime.” He is claiming state administrators wanted to embarrass, ridicule, and shame him for his alternative lifestyle.

“The investigation was overzealous and a waste of taxpayer dollars,” said former Judge John Scipione in his first media interview, “It could have been resolved in its infancy. This case is about a waste of taxpayer dollars and a vindictive, nasty witch hunt aimed at destroying a dedicated civil servant and his family.”

Scipione served as a magistrate in Arapahoe County from 2012 to 2017 and later as a judge, starting in 2018. But after a 30-year legal career, he agreed to resign with a public censure following accusations of inappropriate behavior with subordinates.

A multi-year state investigation resulted in a finding that “Scipione Engaged In A Pattern of Misconduct,” repeatedly using his position “to seek intimate relationships with lower-ranking or subordinate Judicial Department employees and court personnel,” failing to disclose “an intimate relationship with a subordinate employee” when he served as a court magistrate, approximately 10 years earlier.

“That was entirely inappropriate,” Scipione conceded. “It was consensual but it was still wrong. I do regret it. I messed up.”

My husband was career military-I was raised in the country and live there now-hubby and I both had neighbors who were swingers-and what this judge calls “polyamorous” sure sounds like what swinging is-a committed/married couple who have sex with other people with the consent of the spouse/partner. My psych prof called it “open marriage/swinging”-and not a healthy relationship. That is the definition of swinging that I’ve been familiar with since I heard my mom and other women gossiping about some guys “layin’ up with other mens’ wives” -they called it “swapping”. Why the hell would anyone talk about that at work? Might as well talk about satan worship or some other inappropriate behavior...

It was once not uncommon if a woman after two or three years of marriage failed to get pregnant with her husband, she took another man into her bed who would father her children and remain married and in many other ways dutiful to her legal husband.

That custom is/was more like polygamy-swinging is a hedonistic sexual thing-one of my female acquaintances and her husband were swingers for years-being Clint Eastwood macho looking, he was in demand by practically every woman. Asked if it made her jealous, she said no-it is just pleasure-nothing else. There are two polygamous households I know of out here-one a man with 2 wives, the other a woman with 2 husbands-not legally married, so not bigamy. The people are over 65, so no kids or any of that-they are just like everyone else here-both own home based businesses, they don’t hide-but don’t make a big deal of their arrangement, etc-definitely not swingers...
