he U.S. Department of Justice on Tuesday sued the state of Oklahoma to stop implementation of a new law targeting undocumented residents.
The suit in the Western District of Oklahoma follows a DOJ warning last week that it considered the law unconstitutional and a violation of federal law. Tuesday's filing restates that claim and asks for injunctive relief and for House Bill 4156, the legislation creating the law, to be overturned.
“Oklahoma cannot disregard the U.S. Constitution and settled Supreme Court precedent,” said Principal Deputy Assistant Attorney General Brian M. Boynton, head of the Justice Department’s Civil Division, in a press release. “We have brought this action to ensure that Oklahoma adheres to the Constitution and the framework adopted by Congress for regulation of immigration.” Attorney General Gentner Drummond's office referred inquiries to its May 17 letter to the DOJ, in which Drummond argued HB 4156 is a valid response to the federal government's failure to curb the flow of undocumented immigrants, most of whom are reportedly exploiting asylum laws to enter the country semi-legally.
Gov. Kevin Stitt's office also replied to queries by referring to the statement issued Monday, in which the governor criticized the Biden administration.
Oklahoma's new law creates a new category of state criminal law — "impermissible occupation" — for persons judged by the state to be in the country illegally. The first offense would be a misdemeanor, with felonies for subsequent convictions.
Penalties include fines and jail sentences, and the requirement that the person immediately leave the state upon release.
The DOJ said that provision effectively grants Oklahoma "the independent authority to exile noncitizens from the State and permitting a patchwork of state immigration schemes."
It says legal precedent has established that "the authority to admit noncitizens and to determine their status in the United States is a core responsibility of the federal government. HB 4156 impedes the federal government’s comprehensive immigration scheme and interferes with its conduct of foreign relations."
The law, scheduled to become effective July 1, is similar to one enacted by Texas, and which has since been stayed by the courts. That law ordered Texas authorities to deport illegal immigrants to Mexico, regardless of their nation of origin.
HB 4156 just says those convicted must leave the state, presumably on their own.

It is time for the states to simply ignore the federal government.
Immigration will never be fixed with judges involved. I definitely think kids should speak Spanish or they will be at a serious disadvantage in 20 years. I’m not happy about that but it’s already like that in Miami.
Just raise penalties on crimes: shoplifting-Felony -trespassing - Felony - urinating in public-Felony. Problem solved.

“Oklahoma cannot disregard the U.S. Constitution” constitution says our fed government should be securing our borders and protecting US Citizens from invasion, when will DOJ get to work on that? I won’t hold my breath waiting.
