I have litigated successfully against the assertion of claims of executive privilege used to prevent public disclosure by the Governor, at the time, of the State of RI. Executive privilege keeps information secret regarding why a particular policy decision was made by the executive branch. In our case, we showed that the information we sought had nothing to do with a decision thus executive privilege did not attach. In regard to FJB, the tape of the interview and its contents had nothing to do with A POLICY DECISION, therefore Executive Privilege does not apply. PERIOD.

What FJB and Garland are saying, without actually saying it, by this bogus privilege assertion, is the same as Trump’s argument about presidential immunity. Brandon and Garland cannot be seen as agreeing with Trump on this issue, so they now tell another the lie and dig their hole deeper.
