Was he the one who said that the Hawaiian Supreme Court simply reads the words “shall not be infringed” differently than SCOTUS? What a brilliant Constitutional concept! “We read the words “neither slavery or involuntary servitude...shall exist” differently, so slavery is OK”.
But that is precisely what the legislature is supposed to do, and why they are elected frequently, and supposedly accountable to the citizens. It's also why the Constitution has specific instructions on how to make amendments.
This judge, doesn't want to try to persuade the people of the changing values, he prefers the court to be the leaders of change. This is exactly what the founders didn't want.
Crazy how legal opinions work. Two people can look at the same concept and come away with different interpretations...or more accurately: two people look at the same concept, one reads it and applies it as written, and the other makes something up based on feelings.
