Special counsel Jack Smith’s team on May 3 acknowledged they misled U.S. District Judge Aileen Cannon regarding the handling of evidence in one of the criminal cases against former President Donald Trump.
Prosecutors in a court filing said that in some of the boxes FBI agents seized from President Trump’s Florida resort, the order of papers has been changed from shortly after the seizure.
Prosecutors compared scans of the boxes done in 2022 under orders from Judge Cannon to the present state of the boxes and noticed that the order is not the same.

This is grounds for dismissal. Of course Smith will appeal Cannon’s decision and try to have the case moved to another venue with an anti-Trump judge.
That is why Cannon will not dismiss it. A couple of weeks here to think about it, another issue, another hearing, another motion.
Just like the NFL. She’s kneeling on the ball and running out the clock. Jack is losing. She won’t grant him an easy way to refile in another court by dismissing it.
At a minimum, this should get ANY and ALL such evidence tossed from the case. Should also get the prosecutor tossed.
Could get the entire case tossed.

In any normal circumstances this is grounds for immediate dismissal let’s see if it happens it means the evidence has been tampered with it’s not reliable
Dismissal and appeal would NOT result in a different trial judge.
Doesn’t work that way.
Dismiss this damned thing with prejudice and bang the gavel, Judge.

2. If anyone tampers with evidence, that person can be charged with a crime and the evidence is inadmissible.

the crime isn’t misleading...tampering with evidence is.....
So if Smith failed to mention any “insertions,” does he go to prison? If Trump managed to get photos or cataloguing done before the raid, a ‘before and after’ analysis might nail that pr*ck.

Under normal conditions...but the usual rules don't seem to apply when the defendant is Donald Trump.
But this may be the one honest judge in all these lawsuits.
“Misled” = They LIED to the judge!
Again, anyone else and this would have been round filed. Butt, OMB!
So, how are they going to blame Trump for this?
Since they think that Trump is guilty of every bad thing that’s happened since the beginning of time.
And sanctions. DOJ should be ordered to pay all of Trump’s legal expenses, explain their role in lawfare against Trump and pay those legal fees as well. And Trump should sue them personally for violating his civil rights under due process of law.
