A Palm Bay, Florida Homeowners Association board member was arrested last month after allegedly pulling a gun on three kids fishing at a lake in his subdivision, taking their equipment and throwing the rods, reels and tackle into the woods..
Police charged 57-year-old Kyle Patrick Tate with criminal mischief and grand theft as a result of the incident.
A court affidavit filed in Brevard County, Florida alleges that on April 14, officers with the Palm Bay Police Department were dispatched to a suspicious incident at Stillwater Lakes, a subdivision owned and managed by an HOA.
FOX 35 in Orlando confirmed Tate is the president of the community’s HOA.

The responding officers spoke with three kids who were fishing on the south side of the lake in Stillwater Lakes, who said a man, later identified as Tate, walked up to them while holding a firearm and telling them to get off his property.
But the property belonged to the HOA, not Tate, according to police.
Still, Tate grabbed their fishing rods, reels, tackle boxes and other equipment, before throwing the equipment into the woods and damaging them.

The kids told police they estimated the fishing rods and reels to be valued at $1,900; the tackle boxes and lures inside to be valued at $150; and cast nets to be valued at $150.
Tate also allegedly took a phone valued at around $1,500 from one of the kids, which has not yet been recovered,

$1900? My fishing rig consisted of a cane pole, a few feet of line with a float, sinker, and hook, plus a box of crickets for bait. Fun times.

He had every right to tell them to leave.
Did he have the right to ORDER them to leave? The answer is unclear, and almost certainly "no."
Did he have the right, under any circumstances, to commit an armed robbery?
As agent of the HOA, the HOA common property was technically “his”.
If the “kids” were Black, he had justification for fearing retaliation and brandished a gun. It was after all three against one.
There is an issue across the nation with squatters. That is by allowing the “kids” to remain he was in effect setting a precedent for others to come occupy the HOA grounds.
However legalities aside, a more diplomatic resolution would have been preferable

How many times do I have to repeat that he was stupid for pulling a gun, he absolutely every right to ORDER them to leave.
It’s possible the people were not violating the rules by fishing, if the rules prohibit fishing, it’s incumbent to for the owner to tell them to leave, order them to leave or whatever you want to call it.
I wouldn’t have called the cops...

Kudos to those kids, if their fishing rods were worth $1900. Not saying the weren’t, Florida kids know good equipment.
I think they undervalued their cast nets, depending upon what they had, those can cost a lot also.
A gun? Our HOA has not gone that far yet. All I have to deal with are the security cameras and license plate readers at the two ‘hood entrances. They were installed after a murder during a drug deal gone wrong up on the main road thru here. I guess armed guards will be next. (Believe me, people went batSchiff crazy after the killing ...calling for entry gates, armed guards, drone surveillance, neighborhood watches.)

What happens at the end of breeding season, the younger males have flee because the older males are territorial and will eat the young ones, so the younger males follow water and eventually end up in freshwater areas they don’t belong
