They want it both ways: They want to force Trump to take possession of classified documents, implicitly admitting he owns them, then they want to prosecute him for possessing the very documents they forced him to take possession of and implicitly admitted he owned.

A Kangaroo Court that will convict, convict, and convict Trump over and over again.
Doesn't matter if the case is even legal, without merit, or even 100% made up lies.

I did numerous pro bono cases where there were criminal prosecutions arising from dubious furniture renting companies contracts. I won every single case because the DA couldn't prove that the signature on the contract was the defendant's.

This case against Trump, other being a political persecution, hinges heavily on contact law. The DA will have to prove that there was a valid contract in part by signature or performance or agency etc.

That would be sufficient for the judge to be sure.

an inner city school. Reading was not required to graduate.

We used to say “You can indict a ham sandwich”.
Now the media implies, “Trump was indicted. Multiple times. So he’s obviously guilty of everything.”

They have no case. They know they have no case. But they want to smear Trump with all the Nothing in their possession.

You can prove a contract through other means such as performance, ratification, agency etc

If you are an attorney can you explain any of this:
He’s charged under the following statute (per the indictment)

§175.05 – 10A person is guilty of falsifying business records in the second degree
when, with intent to defraud, he:

Makes or causes a false entry in the business records of an
enterprise; or

§175.10 when his intent to defraud includes an intent to commit
another crime or to aid or conceal the commission thereof.

§200.50An indictment must contain:
7. A plain and concise factual statement in each count which, without allegations of an evidentiary nature,
(a) asserts facts supporting every element of the offense charged and the defendant’s or defendants’ commission thereof with sufficient precision to clearly apprise the defendant or defendants of the conduct which is the subject of the accusation; and

As far as I can tell, there are at least 3 elements:

1. false statement
2. intent to defraud
3. intent to commit or conceal another crime.

The indictment only addresses the false statement. Who did he defraud by calling it a legal expense? and of what?

In the last week, I’ve heard probably 20 different “defense attorneys” claim that Trump will be acquitted, Trump is screwed, or some variation on both of those themes. It’s hard to put much faith in any of their opinions.
