U.S. District Court Judge Aileen Cannon denied former President Donald Trump’s request to dismiss the documents case in a ruling on Thursday.
Trump’s team had argued that the Presidential Records Act takes priority over the Espionage Act when it came to highly classified documents he took to Mar-a-Lago after he left office, but Cannon rejected the request to dismiss the case on those grounds, writing in the filing, “The Presidential Records Act does not provide a pre-trial basis to dismiss.”
Cannon also defended herself against attacks from Special Counsel Jack Smith, who had harshly criticized a request she gave both parties. He argued that the judge’s request embraced Trump’s view of the Presidential Records Act, allowing him to consider government documents as “personal.”

Regardless of what the candy-arses think, revenge is sweet.
Notice that she did not rule that the Presidential Records Act does not apply - only that there is no provision for a pre trial dismissal.
Trump can re file this dismissal once the trial takes place - in the future. Once the motion is filed it will take several weeks at minimum to rule and even if she does not dismiss, Trump will have the right to appeal .
This case is not going to go to trial for a long time, almost certainly after the election.
Some people are claiming the PRA defense are bogus. Thoughts?
Cannon will be verfy famlous inUS history. She is following established procedural law while simultaneously trolling Jack ( Off) Smith.
Cannon will rope a dope Smith right into his obvious avanue of ideologial insanity, right up tio NOvember 5th wigthout going to trial. All the TRuimp legal team need to keep doing is bringing procedural motions that have just enough teeth. The Discovery motions alone have endless possibilities, because JAck Off Smith doesnt want anyone to see the poop on the assassination attempt planned for PDJT on Jan 6th, that failed. Cannon wants it to leak out.The documents seized from Trump were proof of the failed plot.
I think she wants it to go to trial with a not guilty verdict. Will make it nearly impossible for Jack Schitt to appeal successfully.
She did a tactical retreat in the face of Smith’s bloviating temper tantrum.

No concerns but my thoughts are these people make it up as they go along....If it flies, fine, if it doesn’t, they just change their minds hoping no one notices...like throwing everything at a wall to see what sticks. We’re bombarded with garbage day in, day out.
I kind of expected. This would be the outcome in terms of the dismissal, but it’s definitely not helping Jack Smith’s case right now.
What this does is make the case a winner for Trump that cannot be appealed by the prosecution. She can still dismiss later.
Once it goes to the jury, and they get her instructions, it’s basically over for Trump. If she dismissed it, it could be appealed.

She will be overturned because the law is very clear, As is the case in all of the cases there is no there there.
They are full of crap and politically motivated liars. Also there were no classified documents in his possession. Even the government doesn’t claim that. They carefully call them “documents with classified markings”.
He was not charged under the laws regarding classified documents. He was charged under the wide ranging Espionage Act for having “National Defense Information”.
That Espionage law does not require it be classified.
The PRA sets the President as the final authority on what documents he can possess. This was already litigated in the Clinton era.

PRA applies. Trump had no classified information. The Archivist cannot overrule the President. The FBI was searching for the records Trump declassified about the five eyes/CIA/FBI Russiagate scam.
And Jack Smith is a low quality lawyer, constantly overturned, mistrials, advancing weird legal theories, has practiced most of his life outside the USA, made his life in Holland, and has the rare honor of being overturned 8-0 (Actually 9-0) by the US Supreme Court.
