Apple has kept an illegal monopoly over smartphones in US, Justice Department says in antitrust suit

WASHINGTON (AP) — The Justice Department on Thursday announced a sweeping antitrust lawsuit against Apple, accusing the tech giant of engineering an illegal monopoly in smartphones that boxes out competitors and stifles innovation.

The lawsuit, filed in federal court in New Jersey, alleges that Apple has monopoly power in the smartphone market and uses its control over the iPhone to “engage in a broad, sustained, and illegal course of conduct.”

The lawsuit — which was also filed with 16 state attorneys general — is the latest example of the Justice Department’s approach to aggressive enforcement of federal antitrust law that officials say is aimed at ensuring a fair and competitive market, even as it has lost some significant anticompetition cases.

Apple called the lawsuit “wrong on the facts and the law” and said it “will vigorously defend against it.”

President Joe Biden has called for the Justice Department and the Federal Trade Commission to vigorously enforce antitrust statutes. The increased policing of corporate mergers and business deals has been met with resistance from some business leaders who have said the Democratic administration is overreaching, but it’s been lauded by others as long overdue.

Those are the kinds of issues that need correction.

Why? It’s a free market. Buy a product that offers those features you want, do not buy a product that does not have them. Do not buy one that doesn’t and then complain when it doesn’t and expect all other consumers to have to kowtow to your desires, accepting a less secure device, merely so YOU can have an open, freely mutable device.

I moved to mac long before there were ‘apps.’ I went through MS-DOS, DR-DOS, early linux versions, minix, trying to get Solaris to run on a 386 processor, etc. When Mac came out with os x (2001?), which was based on BSD, i switched. FInally a solid Unix/posix system that also did all the consumer stuff well (browser, audio, graphics, word processing). I have an iphone now just because it works well with my mac.

…because it works well with my Mac.” Posterchild, if you heard Merrick Garland, that is one of the very things the DOJ is accusing Apple of being in criminal violation of the anti-trust anti-competitive actions that are the basis of this suit. Apple Products work well together with other Apple products to the exclusion of other non-Apple products and that is a criminal act. Apple should make the iPhone and its other products work equally well with every other product, regardless of how safe and secure they might be. Insane leftist thinking.

Same and took some getting used to but my pro max 14 is nearly two years old, used constantly and still runs like new, battery efficiency is still at 98%, etc and short of my physically breaking it will probably serve me well another 2-4 years

I used to replace my Samsungs about every 18 months out of necessity

Thats part of it, but i’ve had many androids which worked with my apple products, just not as well. I find the Iphone SE superior to any android phone i’ve had.

Legally, you can have a monopoly in a particular sector or market, even if you are not a dominant player in a broader market or the world market. I’m not saying that Apple is a monopoly, just that Apple’s share of the U.S. market is more relevant than Apple’s share of the world market.

The Constitution now says whatever any 5 out of 9 Supreme Court Justices want it to say at any point in time. Of course, one problem with having an all-powerful oligarchy of Justices writing and rewriting the Constitution is that another 5 out of 9 Justices can always decide that the Constitution says something different.

very easy. Just use Siri.

My point. You seemed distressed that it didn't do more.

I wish they would steal the idea for a dialer update

Also they are engineered so techs can’t work on them and therefore you have to buy a new one. Channel Louis Rossman.

As others have pointed out, there’s plenty of competition. Don’t buy one.

Apple most definitely does not have a monopoly on phones. What the hell is Merrick Garland smoking!?

The “right” to abortion was due to the right of privacy. The NSA, CIA, FBI and many other TLA’s ONLY exist to eliminate privacy. If there’s a right to privacy in the Constitution, then the NSA, FBI and many more lettered agencies should be shuttered.

I don’t like Apple and never use their products, but I disagree that they have a monopoly on smart phones.

Ditto. I'm a loyal Samsung S-Series consumer and I don't begrudge Apple their success. Apple & Samsung keep leap-frogging each other, so I'm not getting the lawsuit here at all. Seems to me there's plenty of choices here with Apple, Samsung, Motorola, Nokia, Google Phone, etc..

“Maybe it has something to do with the fact that Apple won’t comply with DOJ demands to open locked phones for them?”

Exactly and will not cooperate in turning over personal info either without a warrant.

I remember when blackberry had a very big hold on the business marker. Anyone can knock apple off its top spot with a better/cheaper option. This is stupid. Government shakedown for cash.

While I fully understand your opposition to abortion, I don't think it's a good idea to throw the baby out with the bath water. The 5th amendment clearly demonstrates that the folks who wrote and ratified the constitution understood that it was none of the government's business what we do in our daily lives. As human beings, we definitely have a right to privacy.

The Federalists argued against the inclusion of the 1st 10 amendments to the constitution, arguing among other things that having a list of specified rights would mean that other natural rights retained by the people would be given short shrift. In that, they were obviously correct, which is the reason for the 9th and 10th amendments.

On the other hand, we'd have ended up like Canunkistan without that short list of restrictions upon government, with no right to speak or own firearms without them. I'm glad the anti-federalists won the day on that particular issue.

Odd - I didn’t know Apple made Android phones...

Android devices outnumber iOS devices...

Yet Apple maintains a “monopoly”...?

Someone explain that to me...
