Trump Wins’ – Leftists Melt Down Over Judge Cannon’s Jury Instructions in Jack Smith’s Classified Docs Case

Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts are going apocalyptic.

Cannon gave two options for jury instructions.

The first option:

In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).

The second option is:

A president has sole authority under the PRA to categorize records as personal or presidential during his/her presidency. Neither a court nor a jury is permitted to make or review such a categorization decision. Although there is no formal means in the PRA by which a president is to make that categorization, an outgoing president’s decision to exclude what he/she considers to be personal records from presidential records transmitted to the National Archives and Records Administration constitutes a president’s categorization of those records as personal under the PRA.

I agree, which is why Trump needs to get them on the witness stand justifying how they illegally released that photo but are competent to oversee classification issues of presidential authority.

Good point. There’s another concern. Has the FIB provided proof that ALL ransacking agents held sufficient clearances to even touch the anticipated documents? Has Smith’s clearance been elevated to a level sufficient to read and examine same?

I’ll bet they could find some official who would lie that they were there and cleared the FBI, but they would more likely say they couldn’t talk about it.

Every SCF I was ever in was a no phone, now smart watch no laptop or iPad or any electronics area. No photos could be taken. Also that DOJ photo shows window curtains. Never saw a secret classified facility.

DOJ screwed up even taking that photo and it appears to have been taken outside an SCF.

Again, I don’t believe that the FBI (DOJ) is an authorized downgrading authority for presidential records. From my experience, there are specific steps you need to take to declassify documents. And declassification needs to be explicit on the documents with the declassification authority specified. I have not seen that by the DOJ photo release.

Fully agree. SCIFs are sacrosanct. I cannot understand how this photo was allowed to distributed without the proper and inherent security protocols in place.

Nobody here trusts the FBI. Remember Sally Yates? Before Trump fired her, she made some changes in the DOJ’s NSD. Now nobody outside the DOJ really knows what they do.

The mere presence of a camera or recording device inside a classified facility is a security violation.

So why didn’t NARA realize that Biden was in possession of classified docs for decades and demand them back, or raid his homes if he didn’t respond to them? Why did they only seem to care about missing classified docs when Trump was POTUS? What is NARA’s procedure for determining what’s missing in the first place?

Heck, that’s easy. There is apparently a flowchart on the first page of the NARA procedure. The first node says, “Democrat? - It’s all good”; “Trump? - Anal probe.”

I thought it was supposed to be personal or presidential. “In 1978, Congress passed the Presidential Records Act (PRA), which states that any records created or received by the President as part of his constitutional, statutory, or ceremonial duties are the property of the United States government and will be managed by NARA at the end of the administration.” What I’m saying is that it doesn’t really matter to the indictment what the papers are. If the government said, “Give us those rocks. You were supposed to leave them here” and a judge said, “Yeah, give the government back those rocks,” then he was supposed to return them. Smith is saying he kept the rocks, lied about having the rocks, and hid the rocks. Making public that they were defense documents was just to smear the president.

The Congress can pass all the Acts it wants. None override Presidential perogatives under the US Constitution. NARA, the DOJ, or a judge saying to give them back, and Trump saying go pound sand does NOT then mean Trump was breaking a law of any sort. He had absolute authority to declassify documents, and to declare any record as a personal record. This is a MANUFACTURED crime, whose sole purpose is to taint Trump and interfere in the 2024 election.

Also remember this....

When President Trump was accused of allegedly reading the contents of a classified document OUT LOUD to a reporter, the President was surprised to find those documents in his boxes of documents.

Why? Because he didn’t decide to take them. They were in the boxes that NARA dumped on the sidewalk for President Trump and staff to take with him as he left office. It was how they CONSPIRED to be able to indict him for possession of non-personal classified documents.

Now... here’s the interesting part. It is possible that in their haste to stuff some really good stuff (TS/NOFORN/etc...) in his boxes that they may have accidentally put the BINDER that the FBI raided Mar-A-Lago to find. The one that had all the goods on high level DEM politicians.

God works in mysterious ways. It will be interesting to find out if that is the case.

I was just on Reddit /politics and I just don’t understand how people in this country got so polarized.

Because the politicians need the public at each other's throats so that the public doesn't find out the truth and go after the politicians.

Most people don't get the information on human psychology that is key to self-control and control of others.

The politicians have that info and they got it from THE MEDIA. I have to leave right now but this is the basis of 'control'..... The Law of Three. I'll explain it later (hopefully. busy day)`
