Trump Wins’ – Leftists Melt Down Over Judge Cannon’s Jury Instructions in Jack Smith’s Classified Docs Case

Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts are going apocalyptic.

Cannon gave two options for jury instructions.

The first option:

In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).

The second option is:

A president has sole authority under the PRA to categorize records as personal or presidential during his/her presidency. Neither a court nor a jury is permitted to make or review such a categorization decision. Although there is no formal means in the PRA by which a president is to make that categorization, an outgoing president’s decision to exclude what he/she considers to be personal records from presidential records transmitted to the National Archives and Records Administration constitutes a president’s categorization of those records as personal under the PRA.

Personal records are open for interpretation that is wide enough for trucks to drive through

(3) The term “personal records” means all documentary materials, or any reasonably segregable portion thereof, of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President.

The Archives referred it to the Justice Department and the FBI opened a criminal investigation.

But you’re missing my point. The classification of the documents has nothing to do with the indictment. Saying, “Trump showing off classified documents” in the newpapers is just to undermine President Trump.

But it does, it's a bait a switch. The PRA outlines no specific crime, prosecutorial path or punishment for failure of a President to turn over documents deemed to be “public”

Only if said documents were to be considered “Top Secret/Classified” could a prosecutable crime be concocted.

The Founders wrote that there’s no critter in the ocean to stop the President, except the voter and an impeaching/convicting Congress.

The immunity of a King while in office with checks and balances. That is the President. It makes sense when we have been told that after winning the Revolutionary War against England many wanted to make George Washington a King.

Jack Smith’s entire case has been completely undermined.
I would hope the Trump Legal team files for dismissal with extreme prejudice.

(I’m no lawyer, don’t play one on TV and no, I haven’t slept at a Holiday Inn.)

I content a photo taken in a SCIF would have the highest classification of that SCIF.

You are mistaken. I was security inside SCIFs for many years. A photo taken in secure spaces can be released as unclassified after proper review by security.

Exactly my point, it can be released by the declassification authority. Where is the release by the declassification authority on that photo?

So why didn’t NARA realize that Biden was in possession of classified docs for decades and demand them back, or raid his homes if he didn’t respond to them? Why did they only seem to care about missing classified docs when Trump was POTUS? What is NARA’s procedure for determining what’s missing in the first place? Try thinking for yourself and asking questions instead of relying on the MSM for your “news.”

Where is the release by the declassification authority on that photo?

When congress passed the PRA, instead of making it clear what was required, wouldn't it be more useful as a weapon if they used foggy English? Like not writing what was required?

But the photo was not released by Trump or by his presidential authority, it was released by the DOJ which I do not understand their declassification authority for presidential records.

IMHO the DOJ has no authority to declassify presidential records. Moreso if they are challenging presidential authority as this appears to be the case they need to strictly adhere to classification and declassification requirements, which I believe they failed with release of that photo.

Anyone involved in that photo release should be under investigation.

The DOJ does not investigate or prosecute its comrades unless it has to, and the Biden gang will not usually compel them to do so.

As one J6 defense attorney just said to me—“if Cannon gives these jury instructions, [Jack] Smith is fucked.”

Final jury instructions are well within the purview of the court.
