The Biden administration asked the Supreme Court to weigh in on a controversial law in Texas that allows state and local law enforcement to arrest people they believe entered the country illegally—the latest move in a back and forth on the Texas law that President Joe Biden’s team thinks undermines federal immigration law.
In an emergency request filed to the Supreme Court Monday, the Department of Justice said Texas’ state Senate Bill 4—which was signed into law in December and initially set to go into effect on Tuesday—would “profoundly (alter) the status quo that has existed between the United States and the States in the context of immigration for almost 150 years.”
The law allows state and local law enforcement officers in Texas to arrest and jail anyone they suspect crossed the border illegally, which immigration advocates like the ACLU of Texas are concerned “fuels racial profiling and harassment.”
The law would also put the U.S.’s relationship with Mexico at risk, the filing said, saying that if Texas can “remove noncitizens to Mexico without its consent,” there would be “significant and immediate adverse effects” on the relationship with Mexico that is “critical to the federal government’s ability to effectively address immigration at the southwest border.”
The Biden administration argues in the filing that “the authority to admit and remove noncitizens is a core responsibility of the National Government,” not that of states, and that allowing Texas’ law to go into effect would conflict with past rulings from the court.

It takes 4 justices to grant centiorari, meaning the case will not be heard by SCOTUS unless 4 justices say yes. They may just punt and let the lower ruling stand.

Texas calls them trespassers. Nothing to do with immigration. They’ve been arresting them for years. I think the link I posted will help.

It may be that this has nothing to do with immigration law...but I would not count on it...

Unlike NM, AZ and CA, Texas owns it’s border with Mexico. Almost all of the Texas border with Mexico is in state or private hands. Step on the north side of the river uninvited and you’re trespassing.
The Supreme Court upheld the federalism required by the Constitution today, in requiring federal matters to be addressed solely at the federal level. The same rationale, and clear language in the Constitution, will have them finding that only the federal government can create or enforce immigration law.

Borders and immigration are primarily a federal responsibility.
There is a long history of cooperation between federal, state, and local law enforcement.
Biden’s executive authority does not extend to telling states what to do or not do unless such authority is granted by the legislature by statute (which must also be Constitutional). I am unaware of any such authority.
Is there a law that says state law enforcement CANNOT identify those who are in their state illegally?
Is there a law that prohibits states from arresting illegal immigrants in their states?
Is there a law that prohibits states from deporting illegal immigrants from their states?
Where is the federal law Texas is breaking? Biden and the Emocrats not liking what they are doing does not constitute these actions being unlawful.
