US Supreme Court rules for Trump in historic 14th Amendment ballot eligibility case

The U.S. Supreme Court on Monday ruled in favor of Donald Trump in a historic case challenging his eligibility to seek the Republican presidential nomination under Section 3 of the 14th Amendment due to his actions around the Jan. 6, 2021, attack on the U.S. Capitol.

The court was unanimous in reversing the unprecedented decision out of Colorado that would kick Trump off the ballot under the provision after a state trial court found he participated in "insurrection" on Jan. 6 through incitement.

“For the reasons given, responsibility for enforcing Section 3 against federal officeholders and candidates rests with Congress and not the States," the Supreme Court opinion read. "The judgment of the Colorado Supreme Court therefore cannot stand. All nine Members of the Court agree with that result.”

On holding that only Congress had the power to enforce the provisions under Section 5 of the amendment, it said its decision would apply nationwide.

"Any state enforcement of Section 3 against federal officeholders and candidates, though, would not derive from Section 5, which confers power only on '[t]he Congress.' As a result, such state enforcement might be argued to sweep more broadly than congressional enforcement could under our precedents. But the notion that the Constitution grants the States freer rein than Congress to decide how Section should be enforced with respect to federal offices is simply implausible," the court said.

Trump quickly celebrated the decision, writing on his social media platform it was a "BIG WIN" for the country.

Colorado Secretary of State Jena Griswold said that she was "disappointed" in the ruling.

I don’t know if they have actually printed ballots without Trump’s name on them, not that it would make much of a difference. Most states, if not all, have provisions for a ‘write-in’ candidate...............

Loving this! 9-0 is a clear repudiation of CO and by extension, IL and ME. I expect HELLINOIS (IL) to try and continue anyway, because hey, it's HELLINOIS and Governor Fatso thinks hes' smarter than everyone else.

One last thing: As a resident of HELLINOIS and living in the far western suburbs, the DNC convention in Shitcago this summer is going to be EPIC! 1968 will look like a picnic after this ruling and all the protests! I cannot wait for the 2024 version of the "summer of love!" It's going to be so much fun to watch!

At 9-0, they had no case if they could read English.

For very similar reasons, the POTUS cannot be subject to the 30,000 or so district attorneys in the US. The constitution makes it quite clear that the remedy is impeachment by the house and trial by the Senate.

If every local DA has jurisdiction over the president, it will be a free for all with biased DAs in highly biased jurisdictions hauling a president from the opposing party in for trial before kangaroo courts in which he has no chance at obtaining a fair trial. It will simply devolve into an endless tit for tat game.

If the Supreme Court Justices were committed to Truth and Justice to the extent that integrity and courage prevailed over this decision they would also have made it clear that President Trump did NOT in any way disrupt the peaceful transfer of power, that in No way did he intentionally organize or incite any crowd that breached the Capitol as Congress met to certify the election results on January 6, 2021, that he is in No way constitutionally ineligible to serve as President, and that in NO way did he engage in any insurrection or rebellion.

This is TRUTH. It was a sacred responsibility of the Supreme Court Justices to make this TRUTH absolutely and utterly clear, in no uncertain terms, and it was their authority to do so. They failed.

The failure of the Supreme Court Justices to find within themselves the courage, integrity, responsibility, and truthfulness to state this clearly and decisively endangers the United States and the American People, and it is an abject failure of their responsibility and authority.

At a time when the survival of the United States is under serious threat and heroism is sorely needed, the Supreme Court Justices failed.

The failure of the Supreme Court Justices is an ignominious failure of their responsibility, their authority, and their duty to Truth, Justice, the United States, and the American People. This ignoble failure shall disgrace these Justices for all time. Their shame will last in infamy.

How can a random state judge or other officer then decide he’s guilty?
