NEW YORK -- Within days, Donald Trump could potentially have his sprawling real estate business empire ordered “dissolved” for repeated misrepresentations on financial statements to lenders, adding him to a short list of scam marketers, con artists and others who have been hit with the ultimate punishment for violating New York’s powerful anti-fraud law.
An Associated Press analysis of nearly 70 years of civil cases under the law showed that such a penalty has only been imposed a dozen previous times, and Trump’s case stands apart in a significant way: It’s the only big business found that was threatened with a shutdown without a showing of obvious victims and major losses.

If they do this, then, every other real estate business in New York State has to wonder whether they will be next if they take off the wrong person. The simple fact is that this is the way real estate, investors and companies obtain money from banks. They give an optimistic estimate of the value of their buildings and other property, knowing full well that the banks will do the exact opposite and try to value it at a lower amount, so as to loan them less money. This is a game, it is, played all the time by every single Real estate investor out there.
My prediction is that even if Trump “loses“ this case, it will be reversed on appeal.
A motion for summary judgment can be filed by the plaintiff or defendant at any time after the defendant’s answer, and often is filed after discovery. Such motions ask a judge to decide all, or portions, of a case on two grounds: (1) that there are no disputes of fact that require a trial and (2) that the law clearly favors a specific decision. The parties’ briefs typically include the motion for summary judgment, the opposing party’s response, and a reply from the party that introduced the motion. If the judge grants the motion in whole, the case is over and judgment will be entered in favor of the party who moved for summary judgment. If the judge denies summary judgment, the entire case can go to trial. If the judge grants the motion in part, only those issues that remain in dispute will be tried.

Since all states allow this practice, your state isn’t exempt from doing it.
...that’s right, they couldn’t care less about the future of New York State, the more they can destroy everything the better the Leftists like it.
If the court ended the case that would be legal (not necessarily just) but AFAIK this case has not ended. Assuming that is true, the judge should not admit his bias. He should keep his mouth shut until the case ends, to avoid confirming my suspicion of his bias, but too late now.
You are not backing him.
I don’ t see any fraud. I see a real estate developer valuating property at what he thought it was worth. Apparently the banks thought it was worth it, too.
If you think the DOJ reported to Donald Trump you are too stupid to be left alone outside.
There is no one else worth voting for. If you want to vote for a globalist stooge, go right ahead.
He’s only awaiting what the damages will be.
For one, it’s not fraud to represent that an 11,000 sq ft penthouse is 30,000 square feet in loan docs? Better check your law.
Then how can Trump claim Biden’s DOJ is railroading him?
Excellent comment. Yes, I remember when we sold our house a couple years back an auditor was hired to do an independent appraisal.
THAT exact conversation is happening in neighbor's workspace. They have a distribution center in upstate NY. "If they do this to Trump, it can happen to us!". Needless to say, they are looking to move the center to PA. 200 people will lose their job. Thanks NY!
CA idiocy made them move from LA area to NV. 100 people lost their job there. Companies are VERY aware of business risk and NY/CA are about as anti-corporation as you can get.
Are you unable to make a distinction between administrations? When Eric Holder was AG, he claimed to be Obama's "wingman." The two of them were ideologically eye to eye.
When Trump was sworn in, all of the sudden the DOJ was supposed to be "independent" according to Democrats, RINOs, and the media. The majority of the DOJ leadership worked to hamstring Trump as it was Trump's goal to dismantle the "swamp." There's no way you do not realize this, although I doubt you will admit it.
Now with swamp creatures Biden and Merrick Garland, the DOJ leadership and the president are once again eye to eye ideologically. That's how Trump can claim Biden's DOJ is railroading him. But you already knew that.
Like the time you lied about never having been divorced to win an argument where you were bashing Trump for being divorced...
So, in the end the DoJ does report to the President.
???
Engoron and James, masquerading as public officeholders, are committing fraud.
That's why it's best not to lie in the first place.
That’s a matter of opinion, not fact. And you know what they say about opinions. They’re like butt cracks. Everybody’s got one.
The DOJ is not an independent agency. There are only three branches of the government, and obviously it is in the executive branch. Therefore the yes, the DOJ reports to the president.
Only when Trump was president did I ever hear this “DOJ is an independent agency” BS. (Imagine if someone started to claim that the DOD is an independent agency…)
