The Twenty-fifth Amendment states:
Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.
Thus, in the absence of a majority the candidate would be denied the office. Kamala would have to vacate the VP before a replacement could be named, so there would be no tie breaker by the President of the Senate. In addition, it would have to be approved by the House.

I would suggest Newsom appoint the most qualified individual regardless of race, sex or sexuality. By saying it will be a black women he has disqualified 86% of possible candidates. His action probably disqualified a better candidate.
Just imagine the outrage if a Texas Senator died and governor Abbot said, “I will appoint only a conservative white man!”
