A top Republican election attorney has joined a growing coalition of individuals and organizations investigating whether former President Donald Trump can be disqualified from the ballot due to his involvement in inciting the violent attack on the U.S. Capitol on January 6, 2021.

Jason Torchinsky, a partner at the Virginia-based law firm Holtzman Vogel, has been involved in discussions about the idea of disqualifying Trump with various individuals, including former elected Republican lawmakers, fellow election attorneys and a retired federal judge who has played a significant role in scrutinizing Trump's eligibility. The effort to block Trump has been a hot-button issue for some time. Several groups have filed lawsuits trying to block the former president from the 2024 presidential ballot, citing a provision in the 14th Amendment of the Constitution to argue that Trump is disqualified from holding public office because of his role in the January 6 attack on the Capitol.

Now that one of the most prominent GOP election lawyers has joined the discussion, it makes the lawsuits "appear to be more politically neutral and much less a partisan effort by Democrats to keep Trump from running," Bennett Gershman, a former New York prosecutor and law professor at Pace University, told Salon.

Torchinsky also has ties to three of Trump's GOP primary opponents, doing "legal work for the campaigns of former New Jersey governor Chris Christie and businessman Vivek Ramaswamy, as well as for Never Back Down, the political action committee promoting the presidential campaign of Florida Gov. Ron DeSantis," The Washington Post reported. In this case, Torchinsky is researching the issue for Jacob Harriman, the founder of a nonpartisan service organization called More Perfect Union, Harriman told The Post.

The insurrections (successful, so they are portrayed as ordinary & legitimate transfers of power) were in 1913 and 1933. An attempt to restore constitutional government isn’t sedition or an insurrection.

Section 3 of the 14th Amendment is not applicable to the Presidency.

President is not among the positions specified (Senators, Representatives, Electors) and President does not qualify for “any office UNDER the United States” since the Presidency has never been considered an office under the United States. (McKnight, The Electoral System of the United States, 1878).

Section 3 is not applicable to the Presidency itself. It is ludicrous to think that the authors of Section 3 would explicitly specify Senators, Representatives and Electors but simply forget to include the President. They never intended for this to apply to the President and that is why they specified “Electors of the President” instead.

If you leftist snobs make this happen you will lose the presidency, the house and senate and several governorships and state houses because you took it upon yourself to tell the voters in no uncertain terms who they could and couldn’t vote for in the 24 presidential election. IMHO most of them (the GOP-E) have shown by their action and inaction that they really don't care to win and are content to live on democrat scraps.

Compare their demonstrated lack of enthusiasm to the intensity and fire of the democrats.
Democrats are always pushing the envelope and are always up for a scrap.
The GOP-E act as if they don't want to be bothered with the hard work of governing honestly.

The only time most of them show some life and a real spark of interest is when it has to do with things like their own re-elections and pay raises.
Or ways to channel taxpayer money to lobbyists, financiers and others who kickback enough to them to keep their bank accounts fat.

They are always ready to find common ground with their democrat arch-rivals - not so much with their own presidents.

What is funny is that eventually the Marxist will decide they no longer need their Republican country club lackeys and they will be kicked to the curb or put up against the wall. We are another decade away, if the country survives, of nationally looking like California, where the Republican candidate is not even on the ballot in many elections, just leftist.

They will indeed be rid of Trump, but it will be a Pyric victory for the GOP country clubbers, the jig will be up and they will lose an election that will be stunning from the presidency to dog catcher they will lose and in states it’s not happened in half a century.
