Former White House Chief of Staff Mark Meadows officially filed Tuesday to move the case brought against him by Fulton County District Attorney Fani Willis into federal court, just a day after he was indicted along with former President Donald Trump and 17 others on charges of attempting to overturn Trump's election loss in the state.
The filing from Meadows' attorney George Terwilliger and Atlanta-based attorney Joseph Englert is based on a federal law that they argue requires the removal of criminal proceedings brought in state court to the federal court system when someone is charged for actions they allegedly took as a federal official acting "under color" of their office.
Trump is also expected to mount a similar effort, according to sources familiar with the matter.
"Nothing Mr. Meadows is alleged in the indictment to have done is criminal per se: arranging Oval Office meetings, contacting state officials on the President's behalf, visiting a state government building, and setting up a phone call for the President," Terwilliger wrote in the filing. "One would expect a Chief of Staff to the President of the United States to do these sorts of things."
"This is precisely the kind of state interference in a federal official's duties that the Supremacy Clause of the U.S. Constitution prohibits, and that the removal statute shields against," Terwilliger wrote.
Terwilliger additionally says in the filing that while Meadows intends to file a motion to dismiss the indictment entirely, removing the case into federal court would "halt the state-court proceedings against Mr. Meadows."

OTOH, in a perfect world, Trump in state court could have prosecuted affirmative defenses, and that includes deposing Ruby Freeman, which would have led to dismissal after using the truth of the Fulton County State Farm Arena steal as an absolute defense.

Our legal system is a disaster, and it needs reformation badly.
Years ago I was listening to the radio when I heard an announcement that a man that had spent 20 years in prison had been declared "innocent." Apparently DNA tests exonerated him from having committed the crime. He didn't do it.
So as I was listening I thought to myself, "Doesn't the legal system require that someone be convicted of a crime be shown to be guilty beyond any reasonable doubt?"
"Well if the guy didn't actually do it, how in the world is it possible to prove that he did it? "
The only thing that made sense to me at the time was that the prosecutors were unethical, the defense inadequate, the jurors were stupid, and the Judge was an accomplice to the crime of convicting an innocent man.
How could so much be wrong all at the same time such that it achieved the result of convicting an innocent man?
That's when I started to realize the legal system is more of an exercise in power and less an exercise in reason. It's more interested in going through it's process than it is in achieving a correct result.
And innocent people suffer for it.

After All the President’s Men was no longer in theatrical release, Democrats approached Robert Redford and sought his permission to run the film at Dem fundraising and campaign gatherings. Redford refused outright. “No one should benefit from what happened. Neither party has anything to be proud of.”

Hunter Biden had to admit guilt and give a detailed statement under oath as to what he did in order to prove to the judge that he understood the charges against him, that he was pleading guilty under his own free will, and that the charges against him were likely to be proven in a court of law.
Biden, as a part of his allocution under oath, described the business deal he was setting up with a Chinese businessman. If was after this point that the plea deal fell apart when the defense and prosecution disagreed on the terms of the deal. This left Biden stuck with having already described his crime under oath and then pleading not guilty.
I don't know how he will be able to have his confession tossed out as it happened under oath in open court in front of the judge, the prosecution, and his legal team. So far, everyone's been silent about this.

My guess is that they were Republicans. It fits with a theory I have been pondering for a long time.
