Mark Meadows seeks to move Fulton County election case to federal court

Former White House Chief of Staff Mark Meadows officially filed Tuesday to move the case brought against him by Fulton County District Attorney Fani Willis into federal court, just a day after he was indicted along with former President Donald Trump and 17 others on charges of attempting to overturn Trump's election loss in the state.

The filing from Meadows' attorney George Terwilliger and Atlanta-based attorney Joseph Englert is based on a federal law that they argue requires the removal of criminal proceedings brought in state court to the federal court system when someone is charged for actions they allegedly took as a federal official acting "under color" of their office.

Trump is also expected to mount a similar effort, according to sources familiar with the matter.

"Nothing Mr. Meadows is alleged in the indictment to have done is criminal per se: arranging Oval Office meetings, contacting state officials on the President's behalf, visiting a state government building, and setting up a phone call for the President," Terwilliger wrote in the filing. "One would expect a Chief of Staff to the President of the United States to do these sorts of things."

"This is precisely the kind of state interference in a federal official's duties that the Supremacy Clause of the U.S. Constitution prohibits, and that the removal statute shields against," Terwilliger wrote.

Terwilliger additionally says in the filing that while Meadows intends to file a motion to dismiss the indictment entirely, removing the case into federal court would "halt the state-court proceedings against Mr. Meadows."

At least 4 of the charges GA. Cited were in DC case which is federal. Fed case was first. She can’t even use them.

If this isn’t moved, then any state politically opposed to the current federal administration could target the Feds.

How about Alabama or Oklahoma indicting Biden?

Seems to be no downside to this from what I have read.
It moves for a better chance of a Trump leaning judge, setting up a victory in court. If it fails and he is convicted it has been moved to a venue that can be pardoned by a president. Solid lawyer-ing. But I’m no lawyer, I just play one on the internet.

I would like to see the State of Florida file suit against the State of Georgia in Federal court for violating the civil rights of a Florida citizen (Donald Trump). The case would immediately be remanded to the U.S. Supreme Court.

I just heard Ben Shapiro on his radio program say “the glass has been broken” and that he expects states to begin exactly that.

As much as the courts can bear. But it’s still gallows humor with real gallows at the end.

In the Old West bankers used to force farmers and ranchers out of their land for pennies so their co-conspirator railroad men and retail moguls could take over. Roads, towns and buildings still bear the names of the thugs because they were rich men. Going to the corrupt sheriffs and deputies was not only useless but dangerous because the person could end up a face down corpse in a ravine for acting oppositional.

Only posses and vigilantes prevailed until honest law enforcement and courts came in——sort of.
