Mark Meadows seeks to move Fulton County election case to federal court

Former White House Chief of Staff Mark Meadows officially filed Tuesday to move the case brought against him by Fulton County District Attorney Fani Willis into federal court, just a day after he was indicted along with former President Donald Trump and 17 others on charges of attempting to overturn Trump's election loss in the state.

The filing from Meadows' attorney George Terwilliger and Atlanta-based attorney Joseph Englert is based on a federal law that they argue requires the removal of criminal proceedings brought in state court to the federal court system when someone is charged for actions they allegedly took as a federal official acting "under color" of their office.

Trump is also expected to mount a similar effort, according to sources familiar with the matter.

"Nothing Mr. Meadows is alleged in the indictment to have done is criminal per se: arranging Oval Office meetings, contacting state officials on the President's behalf, visiting a state government building, and setting up a phone call for the President," Terwilliger wrote in the filing. "One would expect a Chief of Staff to the President of the United States to do these sorts of things."

"This is precisely the kind of state interference in a federal official's duties that the Supremacy Clause of the U.S. Constitution prohibits, and that the removal statute shields against," Terwilliger wrote.

Terwilliger additionally says in the filing that while Meadows intends to file a motion to dismiss the indictment entirely, removing the case into federal court would "halt the state-court proceedings against Mr. Meadows."

Long ago Trump the building developer was asked why he had Bill and Hillary Clinton as his wedding guests. “I had a lot of really big plans ahead and I needed to make friends, not enemies for later.”

Seems to not worry about that now. Hope he survives.

It won’t be moved. GA will claim this is illegal activity that tried to affect the outcome of a GA election blah blah blah woof woof.

But it is good nonetheless to point out the errors in this case for public consumption.

On the one hand, protocol, and it will likely succeed, and in doing so, extinguish the charges.

OTOH, in a perfect world, Trump in state court could have prosecuted affirmative defenses, and that includes deposing Ruby Freeman, which would have led to dismissal after using the truth of the Fulton County State Farm Arena steal as an absolute defense.

The real question is: Just how much of a farce is our legal system?

It's garbage. If it ever gets a decision right, it's a lucky accident.

It is so full of ritual and process that it is blind to reality.

It is an altar to sophistry and idiocy and arrogance.

Our legal system is a disaster, and it needs reformation badly.

Years ago I was listening to the radio when I heard an announcement that a man that had spent 20 years in prison had been declared "innocent." Apparently DNA tests exonerated him from having committed the crime. He didn't do it.

So as I was listening I thought to myself, "Doesn't the legal system require that someone be convicted of a crime be shown to be guilty beyond any reasonable doubt?"

"Well if the guy didn't actually do it, how in the world is it possible to prove that he did it? "

The only thing that made sense to me at the time was that the prosecutors were unethical, the defense inadequate, the jurors were stupid, and the Judge was an accomplice to the crime of convicting an innocent man.

How could so much be wrong all at the same time such that it achieved the result of convicting an innocent man?

That's when I started to realize the legal system is more of an exercise in power and less an exercise in reason. It's more interested in going through it's process than it is in achieving a correct result.

And innocent people suffer for it.

Our legal system is trash.

The United States’ legal system is a total farce.

In fact, the entire United States government, in all particulars, is a farce.

It should be ended.

In the Old West bankers used to force farmers and ranchers out of their land for pennies so their co-conspirator railroad men and retail moguls could take over. Roads, towns and buildings still bear the names of the thugs because they were rich men. Going to the corrupt sheriffs and deputies was not only useless but dangerous because the person could end up a face down corpse in a ravine for acting oppositional.

Railroads you say? Corruption in the ranks of powerful corporate interests in the 1870s or so?

I wonder if the railroad barons were Republicans or Democrats?

After All the President’s Men was no longer in theatrical release, Democrats approached Robert Redford and sought his permission to run the film at Dem fundraising and campaign gatherings. Redford refused outright. “No one should benefit from what happened. Neither party has anything to be proud of.”

I want to know what happened to Hunter Biden's allocution that he gave before the plea deal fell through?

Hunter Biden had to admit guilt and give a detailed statement under oath as to what he did in order to prove to the judge that he understood the charges against him, that he was pleading guilty under his own free will, and that the charges against him were likely to be proven in a court of law.

Biden, as a part of his allocution under oath, described the business deal he was setting up with a Chinese businessman. If was after this point that the plea deal fell apart when the defense and prosecution disagreed on the terms of the deal. This left Biden stuck with having already described his crime under oath and then pleading not guilty.

I don't know how he will be able to have his confession tossed out as it happened under oath in open court in front of the judge, the prosecution, and his legal team. So far, everyone's been silent about this.

Do you have a guess as to whether or not the corporate railroad barons were Democrats or Republicans?

My guess is that they were Republicans. It fits with a theory I have been pondering for a long time.
