Supreme Court revives Biden’s ghost gun restrictions

The Supreme Court revived the Biden administration’s restrictions on so-called ghost guns in a 5-4 emergency ruling Tuesday.

The justices agreed to pause a lower court’s decision, which invalidated the regulation nationwide, as the administration continues its appeal.

The decision hands a victory to Biden, at least for now. Biden last year announced the crackdown on ghost guns, referring to firearms that are sold as do-it-yourself kits and are generally hard to trace.

The case will now proceed in a lower appeals court, which is slated to hear oral arguments next month. The matter could ultimately return to the Supreme Court.

Chief Justice John Roberts and Justice Amy Coney Barrett joined the court’s three liberals in temporarily reviving the restrictions. Conservative Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissented.

At issue is how the ATF places restrictions on ghost guns by expanding its interpretation of two provisions of a long-standing federal gun law. The first clarifies that the federal definition of a “firearm” includes certain parts kits, and the second defines “frame or receiver” to include disassembled parts that can be readily converted into a functional gun.

By expanding the definitions, the regulation stretches federal serial number, record-keeping and background-check requirements to ghost guns. But the federal judge in Texas ruled the ATF’s interpretation exceeded the law’s scope. ***

Allowing the judge’s ruling “to take effect would let tens of thousands of untraceable ghost guns flow into our Nation’s communities — with many going to felons, minors, or those intending to use them in crimes,” the Justice Department wrote in court filings.

Probably zero.

On second thought, maybe some ghosts got murdered?

Look how many of the SCOTUS were appointed by Republicans, yet the Vote goes to the Dems.

Why the surprise?

We’re no longer a republic.

And the SCOTUS was compromised years ago.

Now it’s just a rubber stamp for Deep State.

Even if Trump is elected, we’ll still have a Deep State controlled bureaucracy, Congress, and SCOTUS to deal with.

Nothing in the constitution that says a firearm has to have a serial number. Why shouldn’t someone make a firearm without government interference?

That needs to be reiterated. This is just SCOTUS letting things proceed through regular channels first. They haven’t really “ruled” on anything yet.

Hard to trace suggests police will use it as a tool after a crime. In reality, it will be used to pro-actively locate the guns for the registry and eventual seizure.

Hear me out. Has any crime, anywhere, ever been solved by tracing a gun’s serial number? I don’t know of any. In the Hollywood version, a policeman finds a gun near a crime scene, traces the gun, and goes and arrests the person at home. In reality, that never happens, they either have the gun and the perp at the same time or never recover the gun. In the very rare instances where they have a gun and no suspect, a gun trace leads to someone who had their gun stolen or goes nowhere. So I am again: Has any crime, anywhere, ever been solved by tracing a gun’s serial number?

Per usual, the Amish ruin it for everybody.

The most disturbing thing I see from the 'Amish' is setting Glock "switches" AKA autosears to convert a G17 to full auto. Initially I though it was a BS tale until someone with a Class III license did a Youtube video to show the "switches" and the resultant full-auto capability. The devices are easily installed where the slide-in plate at the rear of the slide captures the firing pin and springs. Under 30 seconds to exchange a "switch" for the retainer plate. The street price is as low as $15.

Despite TV detective shows. It’s unheard of for a crime to be solved by “tracing the gun”. And the one time that was massively successful, it was ATF selling them to the Mexican cartels. That “trace” was designed to “prove” that American gun stores were responsible for the trouble in Mexico.

As for solving street crime in America... unheard of.
