It was decided on “free speech” grounds. It seems to me the Supreme Court should have also applied the 13th Amendment: “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.”
Requiring someone to perform a service she/he does not wish to perform is involuntary servitude or modern day government mandated slavery.
Do protected classes come from civil rights laws which banned discrimination?
I know people use that term all the time, and refer to minority groups, homosexuals, and others, as protected classes.
But if we want to be truly equal, why are there protected classes in the place? That’s what I don’t know as to where that concept came from.

I guess Sotomayor didn't get the memo that the court struck down the idea of "protected classes" yesterday on equal protection grounds, in the Affirmative Action case.
So, every business in the USA, of any kind, at any time, could legally refuse to serve you, do a service for you, sell you something, buy something from you?

Joe Biden said yesterday, that the affirmation action ruling would not be the last word on the issue.
His handlers who write his statements for him, told him to say it would not be the last word.
Generally, it seems that, if a ruling goes the way the liberals prefer, then the issue is said to be settled for all time. But if a ruling goes against the liberal view, then that ruling is supposed to be up for review and reconsidered.
