A federal judge has rejected the Department of Justice's request to move legal proceedings over former Trump National Security Advisor Michael Flynn's malicious prosecution claims to Washington, D.C.
"In sum, the Court concludes that the interests of justice weigh against transfer of this case to the DDC. Plaintiff is entitled to seek redress in his home forum, and Defendant’s Motion presents no overwhelming need to disturb that choice," wrote District Judge Mary Scriven in a June 12 order. "The only party who would clearly be inconvenienced by relocation of this action to the DDC is Plaintiff, who would be forced to litigate outside of his home state. The Government is not over burdened by litigating here."
Earlier this year, Flynn filed a $50 million claim against the government for malicious prosecution in connection with the now-thoroughly debunked Trump-Russia collusion hoax. Flynn brought the case in the United States District Court for the Middle District of Florida's Tampa Division. He is a Florida resident.
Flynn briefly served as former President Donald Trump's national security advisor, but quickly became the subject of FBI scrutiny as part of special counsel Robert Mueller's investigation. A retired three-star general, Flynn initially pleaded guilty to a charge of lying to the FBI but requested to withdraw the plea in light of the emergence of exculpatory evidence showing the bureau did not believe he had lied to its agents. Moreover, said agents actively tried to shutter the case against him, but were overruled by their superiors.
The DOJ ultimately asked that the charges against him be dismissed and Flynn received a presidential pardon.
In filing his original claim, Flynn and attorney Jesse Binnall argued that the case against him was politically motivated.

Garland has a well deserved moniker of Meritless.
I still have serious issue with him trading his career military experience and access as a foreign agent to Turkey and Russia. Shame on him, shame on Trump for bringing him aboard. That said, the government abused him and their prosecution was wrong. He deserves justice, and that means maybe that $50 million plus attorney fees. Will it make things right? Better if the folks that perpetrated the malicious prosecution are themselves tried, convicted, jailed, and lose their pensions.
And afterwards, they can burn forever!
You knew they would try. Everybody knows the DC Swamp from judges to juries to the DOJ is thoroughly corrupt.

If you feel that way about Flynn, then you should feel the same way about every member of the military who used their career experience to act as an agent to foreign countries. There's plenty of them that have done it, but not held to the same legal standards as Flynn has been. I hope he wins big time. Bet General Milley will be an agent to the Chi-coms. I just have a feeling that since he's willing to alert our biggest enemy ahead of any attack on them, that he'd be in Xi's good graces, to make some cash after he retires this year, if is isn't already doing so.
Yes, I have a problem with any government worker, elected official, or service member that trades their experience, knowledge, and access to a foreign government. They are traitors and should be treated as such. BTW, I think I read that there is legislation pending to reign this in but I suspect it will be more smoke and mirrors than real.
Is it against the law? No, and it will likely never be, because plenty of people on both sides of the aisle use it to their personal advantage. You're whining about something you have no control over, and never will.
You are exactly correct. The democrats rule everywhere by intimidation and the average person knows to be afraid of them. The democrats want it that way. And IMHO the average Democrat voter likes belonging to a thug party.
Ah, but consider that Trump promised no lobbyists and all, yet brought people like Flynn and Mannafort in. Yes, that backs up your claim that everyone does it, but it is wrong, and was one of Trump’s bad hiring picks. These people are traitors, shame on them. You know, I served in the military myself, but I could never see trading on that knowledge and experience to a foreign government or company. Never!
Any BTW, I’ve always held this position, regardless of party or who is involved. And regardless of the country they turn traitor with. It is all wrong. And sadly, as you note, there is a long list of well-known people doing this.

I cannot wait to see the two senior FBI executives who entrapped Flynn get cross examined under oath by a competent civil attorney.
I forget the names or mix up all the Deep State executives who were involved in the deliberate destruction of Trump and the Trump Administration.

The judge should have found this stunt to be abuse of process and heavily sanctioned the doj lawyer
Thanks, I knew Scott had some dirt. Life would be a LOT easier for innocent Republicans if others in the party didn’t follow hell-bent, evil, Democrat prosecutors in railroading people just because they worked for Trump (or whoever).
...and it should be NOTED that the Democrat virtually NEVER do that.
