Reagan at one point decided to reveal the capability of a Keyhole Satellite by showing a photo of a Russian carrier. He did it to let them know we could see it all. He deemed that more important than watching silently. Nobody had a right to stop him.

A similar thing is believed to have happened while Trump was in office, whereby he shared some satellite imagery. My understanding is, after that happened, the agency involved then went through the process to actually complete the declassification process. That was necessary to actually declassify it, legally.

Trump can order it, or force it by releasing the info publicly, but it's technically still classified until officially declassified within the classification records management system/process. To think or want otherwise is to invite chaos into what is supposed to be a very tightly controlled environment.

And you're arguments are quickly becoming outdated, because if it's true that the ALL POWERFUL President, even in your theory, admitted some of the documents in question were in fact STILL classified, and in his possession, then he never de-classified them even by simply thinking it.

My point is that the procedures for classifying and declassifying materials are not established by statute, but by executive order. It’s been that way for decades. The current protocols are laid out in Executive Order #13526.

There’s no basis in constitutional law to prosecute a President for failing to follow the legal requirements of an executive order that is subject to his own plenary authority under the U.S. Constitution.

This matter was examined and discussed at length in 2017 when Democrats — and even some Republicans — routinely claimed that President Trump could be prosecuted for obstruction of justice over his firing of DOJ officials like the U.S. Attorney General or the FBI Director. That is utter nonsense, as these executive branch positions were explicitly established by statute to operate under the authority of the President.

Interesting timing and subject matter, if not outright spin or diversion, as per the news report I heard on the way home from work today, that they now have a voice recording of Trump admitting that some (if not all) of the classified items he took home with him were in fact still classified, based on some classified plans to invade Iran. He divulged that in some manner when speaking during an interview with someone about the plan to invade Iran, well after he had left office. Trump told an interviewer something along the lines of “I have this classified plan in my files at home with regard to invading Iran, that proves Milley is wrong, but I can’t show it to you because it’s still classified.” I haven’t heard anything else about that, or seen any threads here yet, but if Trump said that it indicates that he well knew there was a process for declassifying documents that he didn’t go through, and this story here is being seeded to try to spin it in another direction.

Exactly. And this process wasn’t done for the benefit of the President, but to give the agency involved (and anyone else) the legal protection it needed to handle the material as declassified information.

Uh, Milley is Chairman of the Joint Chiefs of Staff (an advisory group to the President), and by law, outside the direct military operational chain of command. This article is BS.

I would make the case that anyone who is both willing to take a job in an executive branch post and able to get confirmed by the U.S. Senate is either corrupt as hell or is pursuing his own agenda.

And that’s a good point, and you have a possible theory, but even best case your theory is in uncharted waters, driven there by Trump’s actions, which were not in the interest of protecting classified information.

But at the core, Executive Orders are directives for how the Executive Branch has been directed to operate. A new President is a member of the Executive Branch, and is therefore still required to operate under those guidelines, until he officially rescinds them with a new Executive Order, legally undoing the previous one.

Trump never did that. Thank gooodness.

Then, there are actual laws that govern the mishandling of classified information. Information that was, once again classified under an Executive Order that Trump was beholden to. Laws such as this one:

Trump is in bad spot here, because he had no documented authority to have these types of documents in his possession, with no record of them ever being classified. His reasons for having them were trivial, primary to serve as trophies from while he served.

And while much the same can be said about Biden, Biden can claim he is just an idiot and lost track of them. Where Trump is really going to have trouble is trying to explain that he KNEW he had them, and per this tape he KNEW they were STILL classified.

So then he’s likely on the hook for not only possessing them, but not turning them over when requested. Was the raid BS, and unnecessary use of power? Obviously, but within their rights to secure classified. Which if true, Trump knew he had.

That's a good question but it's not a magical world.

The simplest answer is to ask President Trump whether a document is classified. Without question, he is the ultimate authority on any document he touched anytime from 2016-2020.

Of course, President Trump knew the Deep State would try something like this, so he issued a Standing Order Declassification which the Special Master has already.

Between the standing order declassifying everything that left the WH, and the President's ability to declassify anytime, anywhere, the only issue is Biden's attempt to reclassify. I actually hope it comes down to that, as President Trump can then explicilty re-de-classify the documents, which would force into the open the question of who is the Real President.
