On Tuesday, a jury simultaneously rejected E. Jean Carroll’s allegations of rape against Donald Trump but held him responsible for sexual misconduct and defamation.
One of the more curious aspects of this case was that the only reason Carroll was even able to sue Donald Trump was because of a law passed in New York in 2022 called the Adult Survivors Act. This legislation, signed by Democratic Gov. Kathy Hochul, introduced a “one-year lookback window for survivors of sexual assault” to legally pursue their alleged abusers, irrespective of when the abuse took place. Many argued it was passed specifically to let Carroll take her absurd allegations to court and punish Trump
It turns out those claims weren’t mere conspiracy theories. In a surprising revelation, E. Jean Carroll’s attorney, Roberta Kaplan, acknowledged that Carroll played a role in advocating for the passage of the aforementioned law.
“The fact that New York passed this law, the Adult Survivors Act,” CNN’s Poppy Harlow said while interviewing both Carroll and Kaplan. “They passed it just a few years ago. Were it not for that law, you never would have been able to bring this case.”
“Exactly. This would never — I would never have this window, this year of having the ability to bring a lawsuit for rape,” Carroll responded, then pointed to her attorney and said. “Robbie can explain it better.”
“Well, E. Jean actually helped to get that law passed,” Kaplan admitted. “It passed last year. We filed – it was Thanksgiving Day, the first day you could sue. We filed it just after midnight on Thanksgiving. And there are a lot of other women throughout the state and, hopefully, throughout this country, that they will get other laws like this passed in other states. ..."

It seems to me that a law like this should not be retroactive to 30 years prior???
Wouldn’t this qualify as a Bill of Attainer?...
Highly illegal.
But, it will take years to work it’s way through the court system.
That’s why the law was temporary...One year, on Thanksgiving, any pending suit will become moot. Clever!!
Ill bet she never sees a dime of that $5 million. 😏
No 5 million but the book ( she ) writes will net her a huge profit
Thanks.
This has to be unconstitutional.
“Ex post facto laws are expressly forbidden by the United States Constitution in Article 1, Section 9, Clause 3 (with respect to federal laws) and Article 1, Section 10 (with respect to state laws).”
Trump is suing the ’Nut Job’ her 5 million will disappear faster then a glass of water in death valley in July once her lawyer gets to help her.
You mean like Ex Post Facto? The Constitution is not applicable in Blue States.
I’m not sure it’s applicable in Red States at this point...
Constitutional issues aside
The point of this is
The smear
The headline
The talking point
With Agenda-Driven/Woke Judges in all the courts, and ambulance-chasers shopping Judges/Juries, we now have no real Legal System in former-USA, anymore.
As long as there are pockets with $$$$ in them, it will not change.
A bill of attainder is a legislative declaration that an individual named person is an “outlaw”, and deprived of civil rights.
There’s plenty of corruption here, but it’s not a bill of attainder.
The appeal should go to Trump and she should be made to pay all court costs for this frivolous fake lawsuit.
I would bet that a good lawyer could make the case that passing a law for the purpose of going after one specific person, even tho’ they are not named, is still a Bill of Attainder.
An ex post facto law criminalizes acts which were legally permissible in the past, and impose penalties on those who engaged in them when they were not unlawful.
There is no ex post facto law, here. This was repealing a statute of limitations. Many States have done this over the past few years, regarding sexual abuse of minors, and been applauded on this forum. I warned back then that it set a dangerous precedent, and that statutes of limitations exist for a good reason.
A good lawyer can make an argument for almost anything. That doesn’t make it right.
Bruce Jenner is not a woman, and this is not a bill of attainder.
No, no. The “book” she will be paid to write will never net ANYBODY any money. The “book advance” she will receive to write the book will be paid early and often REGARDLESS of whether 2 copies, 20 or 200 copies are sold.
Pure corruption on behalf the entire NY democrat party to conspire to prepare a law to permit a lawsuit to persecute single person for a crime that did not occur.
Because Trump supports America. And opposes abortion.
An ex post facto law[1] is a law that retroactively changes the legal consequences (or status) of actions that were committed, or relationships that existed, before the enactment of the law.
