He’s already confessed.
Why is he out on bail?..........................
He ran him down on purpose. That sounds like murder one to me
What’s wrong with these prosecutors???
He’ll do it again
How is this not Premeditated Murder?
He deliberately picked his victim, he gave his motive, and he performed the act.
Amazing the J6 protesters have been rotting in jail for a year and a half without bail for “parading without a permit” and this guy strolls out of the hoosgow like he’s going for a stroll in park after he deliberately murders someone.
The question is where is the GOP? They should be pinning Ellingson’s death on Joe’s hateful rhetoric. They should be shouting about how divisive Biden is.
The left is waging war on us and they want blood in the street. Is our side going to be the last to realize that?
Just plain wrong.
NY Post and Fox News are the only major outlets mentioning this story.
I can’t imagine how Cayler’s family must feel. While they are suffering indescribable grief along with planning a funeral, the justice system has poured salt in their wounds by letting this guy walk free. Sickening.
My fear is this is going to lead to a Bloody Kansas writ large.
Maybe there is a 338 in his near future.
Intentionally running some over is consider: Murder by Vehicle or Vehicular Homicide in some states.
Normally, being charged with that would mean that the suspect isn’t getting a bond.
So:
intentionally run some over to kill them....get a $50,000 bond. Or $5000 to a bondsman.
walk around or in the Capitol on Janary 6, 2021 and you’re held without bond.
Got it. And Republican’s say nothing.
Interesting charges. Seems like the went with lower charges than they could have.
In cases like this, they thrown the book at a suspect and include the worst one and then all the lesser included ones. That way, if the prosecution doesn’t proved Murder, they can prove Vehicular Homicide or Manslaughter. If those charges aren’t included in the beginning, they can’t add them later.
It sure does seem like he had intent.
Vehicular homicide. Criminal vehicular homicide is defined as causing the death of another person while driving under the influence of drugs or alcohol in violation of North Dakota’s DUI laws. A person who has a blood alcohol concentration (BAC) of .08% or more or is impaired by drugs or alcohol to a degree that renders the person incapable of safely driving is considered “under the influence.”
Murder. A motorist can be convicted of murder for causing the death of another person while driving in a manner that shows “extreme indifference to the value of human life.”
The difference between manslaughter and murder is a matter of degree. And the dividing line isn’t always clear. However, in general, murder requires proof of a more culpable mental state than recklessness (the mental state for manslaughter). So, in theory, the more egregious the motorist’s actions, the more likely a jury is to convict of murder.
I would think that admitting to running someone down, killing them, and leaving the scene of the accident would show “extreme indifference to the value of human life.” Therefore, no bond should have been issued.
Strange times we live in.

Is Cayler Ellingson white?
