Multiple Texas counties on Tuesday will declare that the migrant crisis at the southern border is an "invasion," Fox News has learned, a move that could lead to similar declarations across the state.
Kinney County Judge Tully Shahan is expected to announce the move at a news conference Tuesday afternoon, along with a number of other officials from other counties who will join him.
Kinney County Attorney Brent Smith told Fox News Digital that he believes approximately 12 to15 counties could end up having declared an invasion by the end of the month.
With migrant numbers hitting historic levels, and with more than 239,000 migrant encounters in May alone, there has been considerable talk in conservative circles about the merits of declaring the crisis an "invasion" -- which could open up a number of potential legal avenues for states.

Before going to “constitutional carry” Texas had over a million citizens licensed to carry, who had all been thoroughly background checked and fingerprinted. I would tap this pool of citizens first, as I recommended to Greg Abbott three years ago. Something must be done ... and now.
What’s taken them so long? Lots of damage already done. Hope it’s not too late.
Politically, the mess Biden created at the border will be a big issue in Texas and Az come these midterms. All the Republican Arizona gubernatorial and congressional candidates are underscoring the need for the state to spend money to finish the wall here, putting the Dems on the defensive. They can’t make such a promise because their leader and party are diametrically opposed. No Republicans or, more importantly, Independents, are going to believe them if they go off the ranch and lie that they support finishing the wall.
Ultimately, the invasion occurs not only in TX but in all 50 states. Rise up and y’all come to Texas to stop the assault on our nation.
El Paso, Presidio, Brewster, Val Verde, Maverick, Webb, Zapata, Starr, Hidalgo and Cameron all have border towns - Hudspeth, Jeff Davis, Terrell and Kinney don’t.
The governors should declare martial law and order anyone crossing the border to be shot.
