Louisiana trigger law banning abortions temporarily blocked by court

A Louisiana judge issued a temporary restraining order Monday against the state from enforcing its ban on abortions, leading to the immediate resumption of the procedure.

Orleans Parish Civil District Court Judge Robin Giarrusso granted the request of plaintiffs Hope Medical Group For Women and Medical Students for Choice.

The U.S. Supreme Court on Friday overturned Roe v. Wade, which for nearly 50 years had granted women the constitutional right to an abortion.

Providers in Louisiana had stopped performing abortions on Friday, unsure of the legality of the practice due to the vagueness of the bill, according to reproductive rights groups.

“Louisiana’s court made the right call today to swiftly block this unjust ban from taking effect," according to statement by Jenny Ma, senior staff attorney fo the Center for Reproductive Rights, which filed the lawsuit on behalf of the paintiffs.

Some other judge should do a Temporary Restraining Order to stop the killing while this is adjudicated since the killing cannot be undone.

I hope that the answer to your question is the same as my opposition to abortion. That is to save the life of a innocent baby. The baby has committed no criminal act and should be protected.

But I was talking about the usual inclusion of incest as an exception where an abortion would be allowed.

So technically it was left up to the STATES. A state court could find that a state’s constitution guarantees a right to abortion.

We're thinking along the same lines here. It's federalism. We could end up with a bunch of mini Roe v Wades.

A big benefit moving forward is that an individual voice within a state carries way more weight than it did at the federal level. And IIRC, most state supreme courts are ELECTED positions rather than lifetime appointed positions. So, the voter has a bit more ability to replace the judiciary. Something might be "guaranteed" in a state constitution today, but not "guaranteed" tomorrow based on the interpretation of an elected judiciary.

It is also way easier to literally amend state constitutions than our federal one. For better or for worse.

The voter, however he may stand on the issue, has way more power than he did a week ago. I'm pretty confident of that.

Always worth reading the underlying material, rather than rely on news reports.

Page 1, the Lousiana law is void on account of being vague. I’mnot giving an opinion on whther or not that is a fair claim, but it not claiming a constitutional right to abortion.

Especially a two bit Federal judge who may NOT overrule the net result of the SCOTUS ruling, and try to intervene with the State of Louisiana’s laws that have been returned to them by the SCOTUS ruling. This will not last long— but is a ploy to allow the killing money to still be paid to the now illegal “clinics”.

Imagine people being upset they cannot kill babies, and that it was NEVER ever a ‘right’, but a judicial decision that was unconstitutional creating “rights” where they do not exist. Right to Life, Liberty and the PURSUIT of happiness- not the guaranteeing of happiness. Education is needed and they are getting it.

Why is there a United States Supreme Court if any two-bit judge can violate their ruling?

It's a state judge not a federal judge. I'm pretty sure the Louisiana Supreme Court will strike down this ruling.

What part of already adjudicated by the highest court in the land does she not understand?

Well so long as state law doesn't violate the US Constitution or federal law where the federal government has a legitimate power to preempt state laws, the state supreme court is the highest arbiter of state law.

You guys are completely out of control.

The US Supreme Court DID NOT DECLARE ABORTIONS ARE ILLEGAL. This judge is not in conflict with the USSC.

The USSC declares that abortion was not a constitutionally protected right. That means state laws prohibiting it can be enforced.

The plaintiffs of this suit say the Louisiana state law regarding abortion is so vague that it cannot be enforced. This judge said there will be an injunction enforcing the law until any such vague aspects are resolved in an upcoming hearing.

For 50 years after Roe was ruled on the conservatives have passed laws and brought various suits snipping away at the declaration of Roe. Why would you think the Left won’t now do the same? How is it even conceivable that they would not? Because you think it is settled law?

Maybe it will lead to young people in the USA learning what it means to be a republic. The left, while in power, wants a pure democracy. …. Impeach a Republican President on ridiculous grounds as many times as they feel

I haven’t read the law in detail. I think you’re closer than 99% of this thread.

I would add one aspect. A lot of these laws are trigger laws. Passed years ago to take effect if Roe were overturned. That means the details in the laws were never vetted carefully because at the time of passage no one on either side thought it would matter.

That will be the first layer that lawsuits will attack. The laws were simply not well written and no one cared. That will get cleaned up.
