SUPREME COURT ENDS CONSTITUTIONAL RIGHT TO ABORTION

The vote to overturn Roe v. Wade was 5-4. Alito wrote the majority opinion, joined by Thomas, Gorsuch, Kavanaugh, and Barrett.

The vote to uphold Mississippi’s abortion restriction was 6-3. Roberts voted with the majority for that outcome, but he said in a separate opinion that he would not have overturned Roe.

The ruling is 6-3 ONLY on whether to uphold the particular Miss law at issue. One whether to overturn Roe it was 5-4, with Roberts voting with the left to uphold both the Miss law AND Roe.

“Over the protests of Chief Justice John Roberts, who voted to uphold Missisippi’s 15-week abortion ban but not to overturn Roe, the status quo of the past 49 years is gone. (The three liberal justices dissented in full.)” https://fivethirtyeight.com/features/the-supreme-courts-argument-for-overturning-roe-v-wade/

It can’t END something that NEVER EXISTED!

Roe was NEVER constitutional, it was simple judicial activism, period.

Hopefully this will be the first of MANY rulings made by the activist supreme court of that Era to fall.

A secondary benefit of this event: it will overshadow any attention given to the Jan 6 clown circus on the House floor.

The statement is not racist.

The statement is culturist ie, an evaluation of the City State culture that is rotting from the inside.

Youe “racist” evaluation shows unequivically that you have gullibly swallowed the “Every criticism of Black City State culture is bad”. It is not evil to provide criticism

I observe and present a finding

States still retain some power over what goes on in their own borders. Eventually we make get abortion supermarkets or chain stores that market across state lines, but we aren't there yet.

Also, gay marriage already has a built-in constituency of married gay couples, so it's doubtful that the courts could literally overturn gay marriage. If a state wanted to replace it with domestic partnerships, there's a remote possibility that the courts might allow that, but at this point it's not likely.

The driving force behind opposition to Roe was the idea of a right to life. It's less likely that one could find a similar principle to mobilize against Obergefell. State's Rights or Back to the Bible aren't strong enough.

(Twitter has apparently already deleted a tweet by a journalist or TV host expressing a similar sentiment to mine.)

I think the anti-life crowd is, and will remain, for a little while at least, back on its heels, desperately defending anti-life state laws.

Not so significant, as it will be known as a 6-3 ruling.

Also, gay marriage already has a built-in constituency of married gay couples, so it's doubtful that the courts could literally overturn gay marriage. If a state wanted to replace it with domestic partnerships, there's a remote possibility that the courts might allow that, but at this point it's not likely.

That is irrelevant to the question of whether it's constitutional or not and no reason to believe that the current court wouldn't overturn it. The court could strike Obergfell down and leave it to the states, as it was before. And we would have situations where gay couples are legally married in one state, with all the rights and privilege's enjoyed by heterosexual couples, and not married in another having no rights at all.

The driving force behind opposition to Roe was the idea of a right to life.

The sole driving force behind the Dobbs decision is whether Roe was Constitutional or not. The fact that it dealt with the life of a fetus is, as I said, irrelevant.

It's less likely that one could find a similar principle to mobilize against Obergefell. State's Rights or Back to the Bible aren't strong enough.

Don't count on that. Opposition to gay marriage may not be as widespread as opposition to Roe, but it doesn't take an army to sue in court and challenge Obergfell. It's less likely that one could find a similar principle to mobilize against Obergefell. State's Rights or Back to the Bible aren't strong enough.

What a great day. The only thing that saddens me is we don’t have Rush with us anymore. He would no doubt have the best take on the events of today.
