There is nothing in the Constitution about abortion, and the Constitution does not implicitly protect the right.
Congress has nothing to do with it.

Well, two biggies down (Roe and NY Gun Rights case). I’m on the lookout for the W.VA vs EPA case which could severly limit the right of Federal Agencies to unilaterally impost rules and sanctions. Hopefully the SCOTUS will say that Congress actually has to pass specific laws dealing with issues instead of letting bureaucrats create law out of thin air.
Why should it go back to the states?
We fought a law over the legal status of human beings 160 years ago.
Whether or not a baby in the womb has the legal status of a human being should not be dependent upon which side of a state line the mother stands.
In any case, SCOTUS issued the ruling Deep State required.

My only concern now is that either the "Jan 6 commission" or some bitterly ambitious DA somewhere will bring a cooked up indictment against President Trump as a vengeance move against Trump for appointing the SC justices that made this all possible.
Perhaps I am "tin-foil hatting" here, but I don't see these clowns on the left taking this lying down. They need to raise money for the mid-terms.
As I posted here, Alito’s draft opinion had to be revised to prevent a 5-4 decision, and the opinion issued today specifically states (over and over) that BECAUSE abortion is different (which it certainly is), that those other cases are not overruled or endangered by this opinion.
Alito’s original draft overruled Roe because the USSC does not have the authority to make stuff up. THAT opinion woud certainly kill off gay marriage, sodomy, and birth control AS CONSTITUTIONAL RIGHTS, and Roberts would have filed a bitter dissent.
The Court’s session begins in the fall. That’s when she will replace what’s his face.
