Both took notes from a meeting with James Baker shortly after his meeting with Sussman
Judge to rule, perhaps today, what kind of topics Durham's team can get into with NY Times reporter Eric Lichtblau

Bosworth trying to show that the Alfa Bank didnt matter in the scope of things and CH was the important investigation.
Bosworth going back to Priestap’s notes which say DNC and Clinton Foundation. Those are the only parties listed that Sussmann represented in those notes.
Bosworth asks he remembers Joe Pientka or Peter Strzok and another agent named Curtis H. He does.
Priestap doesnt remember almost anything about those notes
Curtis Heide was the FBI agent in Chicago
Adam Goldman
@adamgoldmanNYT
Bosworth asks whether a good way to know a person’s motivations is to simply ask. Priestap agrees.
Adam Goldman
@adamgoldmanNYT
Bosworth noting with a full investigation you can get a secret warrant from the FISC or a T3. Priestap doesnt remember talked to senior FBI leaders about the Alfa Bank allegations.
Adam Goldman
@adamgoldmanNYT
Bosworth shows Priestap an email from him to James Baker, former FBI GC. Baker met with Sussmann. The 9/22/16 emails references Lichtblau and a possible Sunday story. Priestap doesnt remember the email or any convos with Baker about Alfa Bank.
Adam Goldman
@adamgoldmanNYT
Priestap is shown the opening EC regarding Alfa Bank (9/23/16), which is a full investigation. Priestap says he doesn’t remember being involved in the decision to open the Alfa Bank investigation.
interesting

@adamgoldmanNYT
Priestap being asked about internal FBI instant messaging. Theere messages between Pientka and Heide. JP to CH; “People on the 7th floor to include the Director are fired up about this server.”
Adam Goldman
@adamgoldmanNYT
Bosworth shows FBI memo from Dec. 26, 2016 about the Alfa Bank. “From 2008 to 2015, FBI reporting described ties between Alfa Bank and/or key executives and the Russian intelligence services (RIS).”
Priestap is done.

Andrew DeFilippis is questioning Agent Ryan Gaynor who is working in the Norfolk office, where he’s ASAC/NATSEC.
In summer of 2016, he was assigned as a unit chief in CI @ FBI HQ. He attended a conference call with Chicago about the Alfa Bank allegation. He said he would track the investigation and brief the front office.
Convicted in the only remaining court.
That is the court of public opinion.
Hillary’s sentence is her whacko existence.
Plus she will NEVER be president.đ

@JFHaughey58
Former FBI Asst Counterintelligence Director Bill Priestap doesn’t recall taking notes of his conversation with James Baker after Baker received data, documents from Sussmann, doesnât recall context of the notes, or specifics amid Crossfire Hurricane probe.
Under cross-examination, Priestap said he âdoes not recallâ why internal FBI chat messages said âpeople on the 7th floor (leadership) are fired upâ about the allegations or why agents wrote he said they had âno choiceâ but to open an investigation.
Prestap testified that he was unsure if the FBI opened an investigation. The only reason why he knows they did is because there was an ‘EC’ file opened
Gaynor volunteered to work the case. He spoke with SA Curtis Heide and SA Allison Sands in Chicago about the case on 9/23/16
Days later, Heide asked Raynor about where the allegations came from. Raynor asked J.P. where the info came from that initiated the case and he ended up speaking with Moffa. Moffa told him the allegation had come from Michael Sussmann who had provided it to Baker.
Moffa noted Sussmann was an attorney for DNC. Raynor said he understood that Sussmann was affiliated with Dem party but had come representing himself. Moffa said FBI leadership had put a close hold on the info, meaning the field couldn’t know who provided it.

Raynor says there were several FBI efforts underway as part of the investigation. The barracuda logs seemed to indicate there wasnt a covert communication. Allison Sands said the Tor note did not pass analytical muster. Mandiant also determined the allegation did not have merit.
Priestap has the disremembering thingy down pat.
here are some of the e-mail exchanges from the researchers that “found” this data who are pleading the 5th for this trial

@adamgoldmanNYT
An Oct. 4, 2016 email, Heide wrote: “we really want to interview the “source” of all this information. Any way we can track down who this guy is and how we’re getting this information?”

Agent Sands in Chicago conducted an analysis of the logs and they did not indicate a covert communication system.
FBI field office talked to Mandiant about its findings. Did the FBI have reason to trust mandiant because it was hired by Alfa? Gaynor said it corroborated the FBI’s findings.
The FBI received a tip from CHS that the Alfa Bank info had been given to media outlets, Gaynor said. The Chicago FO passed questions to the CHS and evaluated answers. FBI thought CHS was wrong
The CHS alleged David Dagon at Georgia Tech was the potential white paper given to the FBI.
The FBI determined that the allegation lacked merit and the decision to do an overt interview of Dagon could possibly affect the election. FBI didn’t want to violate policy regarding these things so close to the election. So FBI did not interview Dagon
Both Dagon and the CHS were engaged with the media, Gaynor said.
on 10/5/2016, Mark Hosenball(Reuters) emails the FBI about Alfa Bank info. “What can you tell me about all of this?
Hosenball sent an attachment titled: “Global DNS Data”
Leave Questions at tea.leaves@tuta.io
Gaynor repeats there was no covert communication system regarding Alfa Bank.
Gaynor thinks the Alfa Bank investigation was closed in January 2017.
Gaynor said it would have mattered if he knew that Sussman was paid by DNC or political campaign? Yes, he said.
Gaynor was working on election infrastructure and it was highly likely he would not have volunteered if he known the origins of the Alfa Bank material. In other words, the Alfa Bank matter took him away from something much more important, he said.
Bosworth on cross now. Bosworth asking aggressive questions with Gaynor now.
Adam Goldman
@adamgoldmanNYT
Bosworth reviewing Gaynor’s various notes/meetings with the govt to determine when he decided that Sussmann was representing himself.
In his Feb. 2021 grand jury testimony, Gaynor didn’t know if Sussmann was representing DNC.
There is nothing about an impression that Gaynor came to the FBI on his own, Bosworth points out.
