The End of Roe?

Chief Justice John Roberts has confirmed the accuracy of a leaked document that revealed an initial majority vote to overturn Roe vs, Wade. In that memo, Justice Samuel Alito wrote that the 1973 case overturning restrictive state abortion laws was "egregiously wrong from the start." So where do the 64 million babies aborted in the U.S. since that historic decision go for justice?

The leak of the SCOTUS' internal document is hardly unprecedented, but it is rare, and the person who leaked it almost certainly had a political motive. Chief Justice John Roberts, whose vote was not revealed in the memo, must assemble the entire court, including clerks, and discover the one responsible for the leak. At a minimum they should be fired or prosecuted if they broke any law or violated any condition of employment.

Predictably, those supporting abortion were swift to react. Were they prepared for the leak? Senate Majority Leader Chuck Schumer (D-NY) and Speaker Nancy Pelosi (D-CA) issued a joint statement in which they lamented the loss of a woman's "bodily autonomy." What about the baby's bodily autonomy, especially those that have developed sufficiently to live outside the womb if given the chance?

Some believe that Roe has led to a modern version of Old Testament child sacrifices to pagan gods. Modern "gods" are more sophisticated. We worship pleasure and wrong decisions without consequences. The widespread availability of contraceptives, pregnancy help centers and adoption services for those who have unplanned pregnancies do not deter the pro-choicers. To them, abortion is a faux sacred rite.

What's next? Sen. Bernie Sanders of Vermont was quick to issue a statement calling on the Senate to get rid of the filibuster so a majority might codify Roe in legislative law.

Assuming the draft memo reflects the Supreme Court's intent - and especially if Chief Justice Roberts joins with the majority, making it a more substantial 6-3 outcome - there is the matter of enforcement. The issue will return to the states as things were prior to Roe. California and New York, along with some other states, will surely pass laws reflecting the content of Roe. Voters will then decide whether to punish or reward their legislators.

What about states that have - or will have - restrictive abortion laws, including outlawing the procedure in most or even all cases? Will women seeking an abortion within those states be arrested and prosecuted? Will those who perform them be similarly dealt with? An abortion pill is likely to become more widely available so that women who wish to abort at home won't have to visit a medical facility.

The media can be counted on to look for any situation featuring an arrested woman or abortion provider and craft it in a way that promotes the pro-choice position.

The hysterical reaction from many on the left again reveals their belief that they are the sole arbiters of all things and those who disagree must conform or be smeared with what have become familiar pejorative labels.

A Gallup survey in 2010, reported in USA Today, found that "support for making abortion broadly illegal (was) growing fastest among young adults." This was "a sharp change from the late 1970s, when seniors were substantially more likely than younger age groups to want abortion to be illegal." The number of pro-life young adults has likely grown in ensuing years, especially now that high-grade sonograms show details of the unborn child.

If the Supreme Court overturns Roe, it won't be the end of abortion, but it is likely to sharply reduce the number.

The left need a cause to rally to. They want RvW overturned. They need it overturned, they have nothing else to turn out their voters. Ironic, isn’t it?

Overturning Roe v. Wade puts the decision back in the hands of individual States. The voters within each State would then vote their conscience on the matter. The “our democracy” party is terrified of an actual democratic outcome.

Is it really “overturning” anything? Or is it an admission that it should never have been litigated to it’s original conclusion. None of it will matter to the ‘my body my choice’ bunch(as we’ve already seen). A lot of them being the same assclowns DEMANDING you get vaxxed and boosted and pull up your friggin’ mask. Right? So, according to branDUHn next up may be the 13th and 19th amendments being tossed out. Or keeping glbtqrpxyz(gilberts) kids out of classrooms? What total fidiots!

I never understand why liberals love abortion so much.

The sight of Elizabeth Warren hyperventilating and almost crying is not a pretty sight. Her screaming that the American people oppose this is an interesting issue.

If abortion and Roe Vs. Wade is as popular as the likes of Elizabeth Warren think, then lenient abortion laws will be enacted through the legislative process. And that would make the likes of Elizabeth Warren happy.

Do these Democrats not trust the legislative process? If abortion is so popular, then they will get what they want in the state legislatures.

Roberts has not "decided" yet because he must wait until he is directed how to vote. If five justices hold, the left will have to decide if they want to use Robert's vote politically to make it 5/4 and seem to be a close loss, or if they will allow him to appear to remain conservative and be the 6th vote.

OTOH, if one of the five flips they will likely direct him to be the deciding vote in favor of keeping abortion, lest his pedo island visits be exposed.

I wonder what the Latino voters think about the abortion issue. Have there been any polls conducted? Hopefully, this crying act will backfire on the rats in the upcoming election.

I find it interesting that Cal Thomas, a very religious pro life man and a very public Never Trumper not once mentioned that it was President Trump who nominated three Prolife justices.

All this drama... is based on liberal bullsh*t.

If Roe was overturned every liberal state would allow abortion. Same day.

And with the price of an abortion being in the over $500 range most clinics will provide free - state to state - private bus transportation.

Houston to Oklahoma every Tuesday at 10 AM... Abortion's a billion dollar industry - it's NOT going to roll over...

Alito lays out the clear legal logic of why Roe was an constitutionallly egregious decision. Nowhere does Alito base anything on a pro-life moral reasoning. He is all about the Constitution and the law directly, not the indirect outcome. He is no more concerned, from a legal perspective, about the outcome of overturning Roe that respecting the attempt of the Roe decision to produce a desired outcome and the Constitution be damned.

His understanding of what his job is about is 180 degrees from what the Liberal activist judges think their job is about. His is not about mnaufacturing politically desirous outcomes; its all about respecting the Constitution and upholding the limits it places on the Executive, the Legislature and the Judiciary.

The problem for the Left is from the start their objectives about abortion had, and still have, no respect for democratic processes and representative government. It was always about using an acitivist judiciary to circumvent the democratic (elections) and legislative processes (making laws); about using an activist judiciary to obtain a result they could not get by going to the people.

They knew to actually have a right to abortion in the Constitution it had to be one of the enumerated rights in the Constitution. They knew that would require a Constitutional amdendment. They knew that would require years or election and legislative actions to obtain the popular majorities with enough federal repesentatives and in enough states. They knew they could not achieve their result going to the people. They instead used the activist judges to obtain a writ, by judicial fiat, that in fact was not in the Constitution.

The reveral of Roe has to make the pro-abortion proponents understand that if they want abortion as a Constitutional right, they will need to get that right approved and adopted in a Constitutional amendment. It also will say to the pro-life proponents that their work will need to suceed in preventing such an amendment. Meanwhile, democratic action in the states will achieve each states own laws regarding abortion, without the federal courts telling them they must either permit abortion or that they must not permit abortion.
