Younger women who are disillusioned with Biden now have motivation to turn out and vote Democrat.

It's a risk. It could happen. No doubt about it. This could energize Democrat voters in the midterm.

Yet when we look at Texas which has passed one of the strongest abortion restrictions in the country, Abbot is still solidly leading in the polls, so who knows.

One thing we do know is that the MSM will try to make it an issue to bludgeon GOP candidates over the head with (never mind that the Democrats' "abortion at any time for any reason" stance is just as politically unpopular as "no abortion for any reason ever" is).

And SCOTUS decisions Dred Scott and Plessy v Ferguson were overturned by the court itself. Legislation is how something like abortion should become law, not a guess by the better part of nine people.

You are exactly right. This is terrible timing for republicans. I know abortion isn’t a niche issue on this site and passions run high. But this was the last thing we needed when we were all lined up for a dem slaughter in the midterms. Now those one issue radical dbags will come out in force with their hyperbolic predictions of doom to all women if they vote R.

Laws passed by Congress can and have been declared unconstitutional. The SC has put the abortion question where it properly belongs, to individual States to determine.

The Supreme Court hasn't put it anywhere, yet. They apparently are going to say that it isn't up to the Supreme Court itself, but the question of whether Congress can regulate it isn't properly before them.

Unfortunately Roe vs Wade is pretty popular so this issue will help Democrats get their vote out. This may save the Senate for the Dems.

Which is why it was leaked, and which is why RINOs like Roberts will vote for it in order to help Democrats in November.

No, SCOTUS claimed that it found the right to abortion hiding in the penumbra of a a right to privacy implied, but not actually stated in the 4th Amendment.

Congress is supposed to be bound by the powers granted to it and the Federal government in Article 1, Section 8. Nowhere in there is provision for Congress to declare ‘rights’ into existence. Congress could declare abortion legal in the District of Columbia and I suppose on military bases. Their usual way of creating national laws is through the ‘commerce clause’ but I cannot think of how they can use that to justify legalizing abortion nation-wide.

It’s akin to the problem with imposing national mask and or vaccination mandates.
I’m not saying they won’t try, they probably will. I’m just old-fashioned and believe that Congress should follow the text and spirit of the document that established Congress in the first place.
