Warren: Congress ‘Gets the Final Word’ on Roe v. Wade — It Is ‘on the Ballot’

Tuesday, on CNN’s “At This Hour,” Sen. Elizabeth Warren (D-MA) reacted to the leak of the Supreme Court’s draft opinion overturning the Roe v. Wade ruling.

Warren advised that although the Supreme Court could overturn the landmark ruling, Congress “will get the final word on Roe v. Wade.” She added that with the midterm elections on the horizon, the ruling “is on the ballot.”

If the court rules against, it will most certainly NOT be decided in the Congress, as it would require an amendment to the Constitution to give the FedGov jurisdiction. It will go back to the states, where the legal jurisdiction actually resides.

When Roe v. Wade was the “law of the land” it was held by Democrats that the Federal Congress had NO SAY in the issue or its details. Nope, nope, congressional action is totally trumped (don’t you love that word) by the Supreme Court decision. Now that the pendulum starts to swing back, Lia-watha wants the Supreme Court to be ignored.

How about what conservatives have held — the Feds have no business in the issue it is a State issue. You California and Mass people can keep this horrid practice alive for a while longer if you wish but only in your house.

No they won’t cause the law they pass will have to validated by the SCOTUS. But I guess they don’t know and RESPECT that:-)

She’s right. In that if they actually cared about this and wanted to govern they could have passed a law ages ago to tie its legality to funding or something. Heck they even could have put it in Obamacare. But of course they preferred the cudgel stick of “you have to vote for us so they can’t pack the court” (a cudgel the GOP is equally fond of) to keep the base loyal to crap candidates.

Let’s try this:

Urge the Supreme Court to issue its ruling striking down Roe vs Wade and returning authority over the matter to the states. Ask them to do it ASAP.

Let the Dems pass legislation protecting Roe vs Wade, etc. Do it well before the election so the heat in the issue dissipates. Make it an all Democrat show: no Republican votes (except for RINOs).

Immediately upon Creepy Joe signing it, have sympathetic states file suit in US District Court Washington DC and request an immediate injunction suspending implementation. The suit will allege a violation of the 10th Amendment in that the recently returned power of the states to regulate such matters is being unconstitutionally usurped by Congress and the Executive Branch. Ask for permanent injunctive relief. (By the way, this might be the edge to pry a lot of Federal overreach loose.)

The Supreme Court will now be asked to enforce its own ruling by prohibiting Congress or the President from issuing regulations or directives concerning/regulating abortion.

If successful, the only way to implement abortion will be to amend the Constitution. Good luck with that. Not.

Laws passed by Congress can and have been declared unconstitutional. The SC has put the abortion question where it properly belongs, to individual States to determine.

Took them nearly all of 50 years to get it through their skulls. /s

Or, rather, they’re about to lose the biggest cudgel 2nd only to Trump himself to divide moderates and centrists from the right, so they’ll string this out as long as possible. Probably forever. In the meantime, the states will do what they’ve been doing, now affirmed by SCOTUS.

Despite the media smears - and the psychotics now gathering for a most entertaining theatrical performance - it’s nice to see our system work the way it’s supposed to work.

She’s on video getting her a*s chewed on this morning by a male pro-lifer...she repeats the same 69% of voters support abortion that Joe Scarborough was spewing this morning (he was stating a figure of 70%)...guess that’s a ‘talking point’ we’ll be hearing more of...

Percentage of voters for or against is irrelevant in terms of decisions of the Supreme Court. Wouldn’t matter if everyone was for it, or against it.

Exactly. The legislature of each state, per the 10th Amendment, has the power to decide the issue for its state.

Unfortunately Roe vs Wade is pretty popular so this issue will help Democrats get their vote out.

This may save the Senate for the Dems.

The people for whom the right to abortion it their most important political issue are already solid Democrat voters. There's no net gain.

The risk is that Republicans allow the abortion issue to become the central focus of the campaign and candidates in the mold of Aiken and Mourdock step on land mines.

Every GOP candidate is going to be ask if they want a complete ban on abortion (a politically unpopular stance). The best thing they can do is defer to the ruling that focused on states' rights and pivot away from the issue of abortion and onto the economic issues that really affect voters.

Maybe in the past the numbers were high...but I believe there’s younger generations that see the medical science, we know more now, and are not part of their legacy numbers.
