Rubio says 'vice presidents can't simply decide not to certify an election'

Sen. Marco Rubio (R-Fla.) on Sunday said “vice presidents can't simply decide not to certify an election,” breaking with former President Trump after he suggested that then-Vice President Mike Pence had the ability to overturn the results of the 2020 election.

Asked by moderator Margaret Brennan on CBS’s “Face the Nation” if he agreed with Pence — who on Friday said he had “no right to overturn the election” — Rubio said that after examining the matter, he concluded that vice presidents do not have the power to not certify an election.

Imo; Pence as VP had the right to send back elector counts to state legislatures from them to affirm the count, as they have sole authority to do so....not State Executives or Judiciaries.

In other words, he doesn’t have the power to declare a slate of deligates genuine.

If he’s only a ceremonial reader, we can use an animatronic Chucky cheese to serve the role.

Rubio and others miss this point.

The USSC may bat that down, but fine. Nobody else self adjudicated, why should Pence for 70+ Million to play by self imposed rules.

If they can certify, they can NOT certify too. The whole point of certification is to make sure the product or whatever is legit and working as it should. If it’s not, is should NOT be certified!

The vp’s job is to certify, NOT to simply rubber stamp something without questioning it.

Just like then....he can’t contain himself. He made a terrible mistake throwing Pence under the bus. A good portion of the party is still ticked about that. He needs to figure that out....it’s makes him unelectable. Trump needs fix this problem or he will never win if he runs.

And if he finds the results to be invalid, or in need of further review, should he not decline to certify those results?

And if he declines to certify, that is not the same as “de-certifying” is it?”

The VP Certification Process is a Checks and Balance on the Election System.

If Rubio cannot see this he should not be a Sinator!

Of course “vice presidents can’t simply decide not to certify an election”. No one with half a brain thinks that.

However, when it appears that there has been serious and purposeful fraud that may have ruined the legitimacy of an election the VP is one of the firewalls that our Founding Fathers put into place to bring that perfidy to light and perhaps start a process to correct the situation.

Presidents are appointed (indirectly) by State Legislatures.

Please show me where in the Constitution any element of the Federal government (President, VP, Senate, House, USSC) is granted the responsibility OR the authority to "certify" the incoming President.

You can't, because it isn't there.

Congress can choose between competing slates of Electors, when any such exist (there were none in 2021). Congress could, I suppose, flee to West Virginia and refuse to count the electoral votes, but the President-Elect would still present himself to a Federal judge at noon on January 20 and be sworn in, his right to the office being NO WAY dependent on action or inaction by Congress.

I don't know how many times on this pro-Constitution website I have seen people talking about Pence, or Congress, "certifying" the election as if that was a thing.

It isn't, and it never has been.

The VP has always been the vote counter. It’s perfunctory.

If a VP would have ever done it....it would have been after the civil war.

Of course he’s right. The purported ability to do so was of the same species of unicorns as the Insurrection Act, magic executive orders, raids on German server farms, and quo warranto writs. The day the electors voted in the state capitols we were done. The steal was too well done to be timely uncovered and the purported results reversed. I blame the likes of Sidney Powell and Rudy Guiliani for overpromising and under delivering. It was Guiliani who said Christmas week, and I quote “It’s all going to come out at once, right after Christmas.” Still waiting. And Mike Lindell… well… Mike did what he did.

Now, if you’ll kindly join me in this foxhole… I feel a flaming coming on

Because Rubio is good on a lot of things, and this can only be helpful to Trump.

I think Trump made a lot of serious mistakes in being so insulting to his Republican opponents, and he was particularly nasty to Rubio. Trump forgot that he was going to have to work with them later. He was harsher on his GOP rivals than on the Dems.

But Rubio has been pretty good on a lot of issues, and he’s certainly right on this one.

Criticize people when they’re wrong, support them when they’re right.

Then he doesn't have the power to certify either senator? Why not just have the bellhop do the job then instead of a high priced vice president?

If we don't have election integrity marco we don't have a country. And at this point we don't have election integrity....

It’s in the constitution that the VP has to certify the electoral counts. If he feels there is fraud he doesn’t. Then it falls upon the HOR to vote who is president.

Midterms are coming up, and this BS helps no one on our side.

My view is a variation of this:

“The steal on this scale was unprecedented in the modern era. Modern political institutions—local, state and federal— were unprepared to deal with it.”

It required somebody somewhere to be a key actor and stand up, risk their future career and livelihood and dare to become great.

Those who failed to do so (a long list) deserve our disgust.
