Judge halts VA governor’s opt-out school mask order, for now

RICHMOND, Va. (AP) — A judge on Friday temporarily halted an executive order by Republican Virginia Gov. Glenn Youngkin that allowed parents to opt out of school mask mandates for their children.

The temporary restraining order means that mask mandates put in place by school boards may remain, at least for now.

Arlington Circuit Court Judge Louise DiMatteo ruled in favor of seven school boards that filed a lawsuit challenging the governor’s order, one of the first actions Youngkin took after his inauguration Jan. 15.

The judge found that the single issue before the court was whether Youngkin, through his emergency powers, can override the decision of local school boards delegated to them under a 2021 state law that required boards to provide in-person instruction in a way that adheres to COVID-19 mitigation strategies “to the maximum extent practicable.” The Centers for Disease Control and Prevention recommends universal masking, regardless of vaccination status.

“On this pivotal point, the Court concludes that the Governor cannot” override local school officials, the judge wrote in her ruling.

If not in session, the Governor ought to call a special session to overturn the 2021 legislation. I understand that the House of Delegates is now in Republican hands but I don’t know about the state senate.

Q for parents: If all of you refuse to make your kids wear a muzzle, what do you think the publik skrewls will do?

Judges rule us because the left has spent generations telling people that judges are the ultimate legal authorities. They are not.

They rule us because...we...let...them

For months the previous governor overruled the school boards who wanted to end the physical harm and psychological damage caused to children with the masking edicts ... why is it that under the new governor this isn’t allowed anymore?

In WA state some schools are forcing children to eat outside if the temperature is 38-F or above. Meanwhile, teachers eat inside in a communal setting without their masks. Probably so the kids won’t see that the mask mandates is political theatre.

Well, there is something to be said for the principal of local school boards having control. But of course that means a few control the many in this case.

I’d bet that the judge would also find some way to rule that those school boards that don’t want a mask mandate would be required to mandate masks under this same law.

I agree with you. At the same time the governor should take a run at the wording in the law that requires school boards to adhere to COVID-19 mitigation strategies “to the maximum extent practicable.” The information by others than the Dem-controlled CDC shows that masks do not stop infections, are unnecessary for children and do more damage to their childhood development than would contracting the covid do.

I am not familiar with the Constitution of Virginia. Maybe the Governor is required to ask the legislature for authority?

Democrat governors can do anything they want. No limits to their powers.
