Supreme Court Justice Stephen Breyer announced his retirement this week, setting off a flurry of rumors around a potential replacement. However, voters now say they are not in favor of President Joe Biden’s plan to choose a nominee based on race and gender.
Biden promised multiple times on the campaign trail to nominate a black woman to the high court.
Polling from Rasmussen found that idea does not have as much support as Biden might think. Only 26% of those surveyed say basing Supreme Court picks on race and gender is “a good idea.” In fact, only 16% of independents say it is a good idea, compared to 47% of Democrats and 11% of Republicans.
A majority of voters expect President Brain-Dead Biden to keep his campaign promise to nominate a black woman to the Supreme Court, but they don’t like the idea of choosing justices on the basis of race and gender,” Rasmussen said. “A new national telephone and online survey by Rasmussen Reports finds that 59% of Likely U.S. voters expect Biden to keep his promise by nominating a black woman to fill the vacancy on the Supreme Court created by the retirement of Justice Stephen Breyer. Only 19% think Biden will break his campaign promise, while 21% are not sure.”
Others have suggested Biden nominate a centrist or Republican black woman to unite the country.
If he wants to unite the country, Biden should nominate Janice Rogers Brown,” said Sen. Josh Hawley, R-Mo. “Committed constitutionalist who is also an African-American woman. Sadly, Biden personally filibustered her historic nomination to DC Circuit twice when he was in Senate. Now is the time to make amends.”
And it is just plain wrong!!
In days of yore, before equal opportunity laws and quotas, there was one seat on the Supreme Court expressly reserved for a justice of the Jewish faith. Some prominent names come immediately to mind: Louis Brandeis, Arthur Goldberg, Abe Fortas, Ruth Bader Ginsburg.
Somewhere along the line, new standards were established. A nominee's religion became less of a concern to the Senate than his or her personality traits and behavior. How a candidate for the Court worshipped was no longer important; rather, confirmation hearings were more often focused on digging up dirt (cf., Kavanaugh). As a result, it's now possible that a majority of the nine justices might be of the same faith.
Imagine that!
The Supreme Court is comprised right now of [drum roll please] two Jews and seven Catholics or Anglicans.
Zero Muslims, zero Mormons, zero Christian Scientists, zero followers of L. Ron Hubbard.
Where's the balance? Where's the diversity?
Should anyone care? Would an African-American female, as promised by sleepy Joe, change the balance in any substantial way?
It would appear that control of Congress, which is a distinct possibility for Republicans this November, might be a more worthwhile goal than mounting a losing campaign against the mystery black woman who sleepy Joe promises to nominate in March.
