SUPREME COURT STRIKES DOWN OSHA VACCINE MANDATE
BREAKING: The Supreme Court BLOCKS the federal government's COVID-19 vaccine-or-test requirement for large workplaces. The court ALLOWS a vaccine mandate for workers at federally funded health care facilities to take effect nationwide.— SCOTUSblog (@SCOTUSblog) January 13, 2022
Bring it on! I cannot wait to get some good practice in on moving targets.
The opinion on the health care vaccine mandate is here: https://supremecourt.gov/opinions/21pdf/21a240_d18e.pdf."
Thanks. Of more help then citizenfreepress.com
Also, from NBC:
"Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly," the court's conservative majority said. "Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category."
The Supreme Court on Thursday said a separate regulation that requires vaccinations for health care workers who treat Medicare and Medicaid patients could be enforced. - https://www.nbcnews.com/politics/supreme-court/supreme-court-blocks-biden-admin-s-covid-requirements-workplaces-allows-n1287435
Kavanaugh hears great things about those DC cocktail parties and wins in. Yeah. Good luck on that, moron. Zero surprise. All of Trumps sr picks were in place to sabatoge him and he’s not very good at finding great staff. Stands to reason that on a SCOTUS pick of all roles, they’d REALLY screw him (us) over
He heard they have lots of beer there.
Yep. Almost all healthcare workers have federally funded employers.
thank you PRESIDENT TRUMP!
And you are an idiot.
The ruling says the CMS rule can be mandated. CMS is the body that governs Medicare/Medicaid. *ANY* medical facility that accepts Medicare/Medicaid falls under this ruling. That includes so-called "private" hospitals. It includes pretty much ALL hospitals.
Maine never had a flu shot mandate for healthcare workers until this year. Our D governor instituted it along with the covax.
I’m a lawyer. I have family in Texas and Minnesota who work in healthcare and are not mandated to receive the annual flu shot. You must have a select circle of connections in a small number of states.
That's correct. There are plenty of health care workers who have never been mandated to get an influenza vaccine as a condition of their continued employment.
You can disagree without being rude.
I’m reading it again. I may have been wrong.
Thanks for your rude reply.
Carry on.
Very bad news for healthcare and liberty. The ruling is a Trojan Horse because it makes facilities with taxpayer funding, aka Federal $, force their employees into being part of the experimental trial of the damaging and killer injections involuntarily. The one bright spot is more whistleblowers will come forward now exposing what has really been happening in the facilities when they are forced to resign.
RE: Private Hospitals, most are Non-Profit Corps. but all are Private Businesses.
If a private healthcare facility/hospital offers vaccination, Covid testing and Covid treatments, doesn’t it mean that they DO receive Federal funding? And uf so, aren’t they covered by the Federal vaccine mandate?
Justice Thomas’s last line of dissent:
These cases are not about the efficacy or importance of
COVID–19 vaccines. They are only about whether CMS
has the statutory authority to force healthcare workers, by
coercing their employers, to undergo a medical procedure
they do not want and cannot undo. Because the Government has not made a strong showing that Congress gave
CMS that broad authority, I would deny the stays pending
appeal. I respectfully dissent.
Simple, straightforward, elegant, correct.
Justice Alito’s last line of dissent:
Today’s decision will ripple through administrative agencies’ future decision making. The Executive Branch already
touches nearly every aspect of Americans’ lives. In concluding that CMS had good cause to avoid notice-and-comment
rulemaking, the Court shifts the presumption against compliance with procedural strictures from the unelected
agency to the people they regulate. Neither CMS nor the
Court articulates a limiting principle for why, after an unexplained and unjustified delay, an agency can regulate
first and listen later, and then put more than 10 million
healthcare workers to the choice of their jobs or an irreversible medical treatment.
Therefore, I respectfully dissent.
¡SÍ!
“That will eventually die when they have no one willing to work in their hospitals.”
Or they lose employees as the succumb to the clot shot.
Also, that has been fairly common knowledge since November, when they first created that rule. You've had plenty of time to figure it out, yet chose not to.
So I called it as I see it.
Walmart, RiteAid, Walgreens, and Kroger offer Vaccinations.
Someone should tell Kuckvanaugh that no matter how hard he cuck$, the Lefties will still hate him.
Like VA, Indian Health Service etc
