Novak Djokovic has won his court case. Judge Kelly found the decision to cancel the visa was “unreasonable.

Note - this isn’t over. There are other avenues by which the Commonwealth government can still cancel his visa. But doing that would be deliberate intent, rather than just the mess things have been up until now.
Meanwhile, thousands of others - who happen to NOT be famous tennis stars - languish in confinement.

No doubt, they can do what they want, but at what cost. They lost in their own court, where they presumably have a great advantage. They already look like they acted in bad faith. They would hang a cloud over this year’s Open. And what message would they send to their own courts, etc.
Hopefully Omicron will make this all mute.

Federal Circuit Court judge Anthony Kelly ordered the immediate release of the tennis world no.1 from immigration detention just after 5pm after overturning the federal government’s decision to cancel his visa.
Judge Kelly told the hearing the decision to cancel the temporary visa was to be quashed and the respondent, being the Minister for Home Affairs, to pay his costs and to take “all necessary to steps to release the applicant immediately”.
Djokovic’s lawyer Nicholas Wood, SC, confirmed the tennis star was currently with his legal team at a location that is still unconfirmed.
A federal judge earlier questioned what more the tennis ace could have done to be granted legal entry into the country...

Congratulations to Australia and Judge Kelly. It turns out that Australia is like the USA; most government officials are crazy, but there are a few sane judges who try to keep them from going off the deep end.
This was a political decision by Morrison to intervene and cancel Djokovic visa and the court rightfully restored his visa after reviewing the facts in this case.
The govt may have other routes to still deport him but Djokovic has proved his point and the Morrison govt is embarrased.
Politicians in Australia have made their own country a pariah in the eyes of the world.
NOBODY thinks Australia is being reasonable with their draconian COVID policies EXCEPT the brainwashed and fear-possessed people living there.
Australia is NOT pursuing a rational and scientific response to virus transmission.
Australia is following a “Howard Hughes Obsession” with microscopic threats. It is fascinating to watch an entire country collectively become as irrational as Howard Hughes himself became toward “germs.”
You cannot be an active participant in the world when your international reaction is to abandon reason and common sense and flail in panic like a drowning victim.
Australia answers, “Yes,” to the question: “Can an entire continent lose its collective mind?
No, it wasn't. Why do people think they can just make up bull like this. It's moronic and completely misrepresents how Australia's system of government works. The Prime Minister is not a tyrant who do anything he likes. If he was COVID would have been handled completely differently in this country.

Frankly, I think the court decision is awful. This judge has just given Victoria the right to set entry standards for the entire country (and not just Victoria, every state individually, which would seem an impossible situation legally speaking). I can’t even see how it’s vaguely constitutional and it’s yet another example of a judge ignoring the constitution.
He’d probably claim “It’s the vibe of the thing.”
That’s not to say, I don’t think Djokovic should be given relief. At this point, I do accept he was mislead. But that could have been done with a temporary injunction.

The issues here have been created by the state governments, not the federal one. I wish to God, the Federal government was actually in charge.
And what this court decision has done is strip away one of the few areas where it still was in charge. This could be a disaster.
Sane judge = judge who completely ignored the Constitution in this case.

The problem is, Australia seems to have a collective obsession with getting rid of Covid entirely, 100% ... and that’s not possible
nobody says “we have to be completely rid of the flu, because it’s killing the elderly” [which is true] ... Australia’s current over-reach is counter-productive and hurting people, businesses, the whole country
yet anybody who questions the Government’s moves is treated like a menace
not a good look!
