It was an all-but ugly day in court for the prosecutors hoping to put Kenosha shooter Kyle Rittenhouse behind bars on six counts, including murder. During a lengthy evidentiary hearing, the defense scored victory after victory while the government was increasingly frustrated at the judge’s rulings in favor of the defendant.
Assistant District Attorney Thomas C. Binger argued that the defendant is a “teenage vigilante” — and a “violent vigilante” at that. But that was precisely the problem with the state’s evidence, according to Kenosha County Judge Bruce Schroeder.
The government quickly lost two motions to introduce two pieces of evidence outright. The first piece of evidence showed that Rittenhouse attacked a woman who was involved in an altercation with his sister in June 2020. The second showed that Rittenhouse has various affiliations with the far-right Proud Boys organization.
In both instances, the judge ruled that the government’s offered evidence would be far more prejudicial than it was worth.

But one new piece of evidence discussed at the hearing may prove to be instrumental for the state’s case against the 18-year-old. Near the end of the hearing, amidst a detailed back-and-forth discussion about who began the chase that turned deadly on the night in question, the government revealed they have a video from an “FBI” aircraft that shows Rittenhouse initiating hostilities against Joseph Rosenbaum. The defense said they hadn’t seen that evidence before.

Would the FBI have doctored the aerial FLIR images? They’ve had plenty of time, and the image resolution need not be too high. Now you may think I’m being hash here, but this is the same organization that protected the kiddy-diddler doctor of the USA female gymnastics team - for years.

There was a time when the law only strove to punish behavior, not beliefs.
It only has to be good enough to fool, I mean, convince a jury.
No it isn't. Springing it in the middle of a hearing is not disclosing evidence to the defense. You like being on the wrong side of things, don't you?
The prosecution withholds evidence from the defense, and then tries to present it in testimony, it gets its wieny whacked...
I wonder how much this infrared drone video has been tampered with too. It’s from the federal bureau of entrapment, you know.
I need you to know something.
The idea that Kyle Rittenhouse was the one who stopped him from pushing the flaming dumpster and put it out with a fire extinguisher is a piece of misinformation that WILL NOT DIE.
It is NOT true. It was a case of mistaken identity. I could show you who it was on a video. It was another person at the gas station.
Oh come on. We all know that long distance aerial imagery always provides a totally accurate view of what is happening on the ground. That's why the Biden administration was able to target a group of ISIS terrorists in Kabul earlier this month and blow up their car with a missile.
Oh, nevermind, the car was actually full of kids and a person who assisted the US in Afghanistan.
But you can definitely tell exactly what is going on from aerial images.
The scary thing is they watched the guy in Kabul drive around for eight hours handing out potable water and sacks of food. But since they decided in their minds he was a terrorist it was bomb stuff.
Eight hours.
Talk about tunnel visioned thinking.
Ah. I presume they are within some kind of legal limit as well.
“ The FBI withholding evidence… again.”

Discovery? We ain’t got no discovery! We don’t need no discovery! I don’t have to give you any stinkin’ discovery!
“This would be the same government that used drone surveillance in Afghanistan to murder 10 civilians, 7 of them children”

IR is usually not admissible.
“No it isn’t. Springing it in the middle of a hearing is not disclosing evidence to the defense. You like being on the wrong side of things, don’t you?”
OBVIOUSLY you missed that day in law school where they discussed evidentiary hearings.
This is not discovery. It is an evidentiary hearing.
Every one of us saw dozens of first hand videos showing Kyle running from a mob of angry people. That mob caught him and whacked him in the back of the head with a skateboard. he fell to the ground and he was pounced upon. He defended himself and then sought out the police. It’s a cut and dried case, and Kyle deserves to be a wealthy man one day.
If the footage of Rittenhouse shooting Lefty does not show that ANTIFA guy in the background getting a blow job, then it is bogus.
The defense didn’t know about it so they couldn’t argue the merits of the evidence. That’s not disclosure, that’s a cheap ambush, by a cheap prosecutor.
You know about that kind of tactic, you cheered for that for two years in Texas.
Depends on how you determine “initiated”. KR was asked to guard buildings so ofb the confronted rioters hell bent on burning his building(s), then he was doing his job by being armed and visible. Nothing against the law there unless you subscribe to meek passivity.
The scary thing is they watched the guy in Kabul drive around for eight hours handing out potable water and sacks of food. But since they decided in their minds he was a terrorist it was bomb stuff.
