It was an all-but ugly day in court for the prosecutors hoping to put Kenosha shooter Kyle Rittenhouse behind bars on six counts, including murder. During a lengthy evidentiary hearing, the defense scored victory after victory while the government was increasingly frustrated at the judge’s rulings in favor of the defendant.
Assistant District Attorney Thomas C. Binger argued that the defendant is a “teenage vigilante” — and a “violent vigilante” at that. But that was precisely the problem with the state’s evidence, according to Kenosha County Judge Bruce Schroeder.
The government quickly lost two motions to introduce two pieces of evidence outright. The first piece of evidence showed that Rittenhouse attacked a woman who was involved in an altercation with his sister in June 2020. The second showed that Rittenhouse has various affiliations with the far-right Proud Boys organization.
In both instances, the judge ruled that the government’s offered evidence would be far more prejudicial than it was worth.

But one new piece of evidence discussed at the hearing may prove to be instrumental for the state’s case against the 18-year-old. Near the end of the hearing, amidst a detailed back-and-forth discussion about who began the chase that turned deadly on the night in question, the government revealed they have a video from an “FBI” aircraft that shows Rittenhouse initiating hostilities against Joseph Rosenbaum. The defense said they hadn’t seen that evidence before.

It would be interesting to see how many other cases in how many other cities they have used this footage in, as I expect the answer is none.

I think every decision by the judge is sound.
Or they just took IR imagery from Afghanistan or somewhere and told the judge it was whomever. How do you ID people using IR? All you can see is a heat signature!
I don't think that prosecutors can withhold evidence like this from the defense, at least in a US court.
Move the trial to anywhere in China and the prosecutors don't even need evidence, just a word from the CCP.
Bullcrap. That is the FBI **characterization** of the event. Rittenhouse stopped him from pushing that flaming dumpster into the gas station and put it out with a fire extinguisher. In the twisted minds of the FBI traitors, that is Rittenhouse “initiating” a confrontation.

Defense counsel for Rittenhouse said they were unaware of the FBI aerial surveillance video...isn’t the prosecution required to turn over all the evidence collected?

This would be the same government that used drone surveillance in Afghanistan to murder 10 civilians, 7 of them children.
Kenosha went up in flames.
Was one arsonist arrested?
And what right did the FBI have to be doing this?
And, note the language? “Convinces judge”. Not judge rules or judge decides. No it must be some sort of manipulation of the judge.
And, I doubt there is any evidence that shows what this article claims without any evidence.
