Why Joe Biden can't resign, or be removed — or die

In the wake of the Afghanistan debacle, demands have arisen in Congress for President Biden to resign or to be removed via the 25th Amendment.  Elements of the formerly pro-Biden media have joined in the condemnation.

Many silent Democrat office-holders likely want Biden out, as they fear that the systemic incompetence of his administration will bring them down come 2022.

But Joe cannot resign or be fired.  The Democrat high command will not let either happen, no matter the short-term political cost.

On the surface, that makes little sense.  Joe's resignation or removal would not alter Democrat control of the presidency and Congress.  If Joe leaves, Kamala Harris becomes president.  She is incompetent, too, but no more so than Joe, and is on board with the administration's radical agenda.

So.  Why can't Joe quit the office or be removed? 

Article I, Section 2 of the U.S. Constitution states: "The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided."  The current Senate is equally divided with 50 Democrats and 50 Republicans.

As soon as Kamala Harris takes the presidential oath, the vice presidency is left vacant.  In that case, a tie vote means that the legislation, resolution, or confirmation under consideration fails.

A Senate chamber without a vice president puts Mitch McConnell in the catbird seat.  He can kill all Democrat initiatives, including any nomination to refill the vice presidency.

The Democrat agenda goes up in smoke.  The 3.5-trillion-dollar budget reconciliation bill is blocked.  The For the People bill is blocked.  The Green New Deal is blocked.  Packing the Supreme Court is dead.  As is any attempt to scuttle the filibuster or grab guns.

This article is wrong. The Vice Presidency doesn't just go vacant when the VEEP ascends to POTUS and stay vacant. The new POTUS appoints a new VEEP who must be confirmed by both houses of Congress.

The 25th Amendment to the U.S. Constitution was passed by Congress on July 6, 1965 and ratified by the states on February 10, 1967.

Section 1.
In case of the removal of the President from office or of his death or resignation, the Vice President shall become President.

Section 2.
Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.

There's no lame-duck or dead-duck Senate scenario. Following Xiden's ouster or undster, Harris is deep-stated to the throne, and under 25A § 2 appoints a VP for the Senate's simple majority approval.

Could easily see Miotch approving Cankles beforehand, in order to destroy the 2024 Democrat primary.

I think they’d use the animatronic Biden. That would perform much better than the real deal. They might even include a “fondle” feature for live photo shoots to allay any suspicions.

Clayton did NOT do his homework - his whole article is ridiculous:

This last happened in 1974, when Vice President Gerald Ford — himself a replacement for Vice President Spiro T. Agnew, who resigned after being accused of tax evasion — replaced President Richard Nixon. Ford nominated Nelson Rockefeller to serve as his vice president, according to the Gerald R. Ford Presidential Library and Museum.

LOL! This truly is the straw that broke the camel’s back.
Not only did these fools paint themselves in a corner, they put up traffic cones showing their intention to stay there -
PERMANENTLY (or at least until there is another election).
So what are common citizens to do? March to DC to show our displeasure, joining the others from our prior march to do the same? Highly doubt that agenda!

Does anyone believe Romney or Murkowski or a half dozen others would let 50-50 stand? McConnell may have such fantasies but only one with a sense of reality does.

Yes, an appointed VP has to be confirmed by both House and Senate, and is confirmed by a simple majority vote in each House of Congress.

What I don’t know offhand, is could the GOP in the Senate filibuster a VP nominee???

Naked opportunism on their part might make it more advantageous for them to simply let Biden’s presidency be a lame duck.

They can sit and do anything they want and not get a single law passed and Biden gets the blame.
