Convention of States: Ohio lawmakers calling for state to join movement for constitutional assembly

Two Ohio lawmakers plan to introduce a resolution this week calling for a convention of states to address the size of the federal government.

State Reps. Riordan McClain (R-Upper Sandusky) and Craig Riedel (R-Defiance) said they plan to introduce the resolution, which would create a convention that could discuss the topics of "limiting the power and jurisdiction of the federal government, term limits for Congress and other government officials, and fiscal restraints for the federal government."

"The size and scope of the federal government have long been unsustainable, and we have waited long enough for Congress to fix itself," McClain said.

Having 34 states — or two-thirds of the 50 states — call for a convention is one of two mechanisms to propose a constitutional amendment. The other is direct action from Congress.

Fifteen other states have passed a similar resolution. Georgia was the first state to pass a resolution to create a convention in March 2016. Since then, Alaska, Florida, Alabama, Tennessee, Indiana, Oklahoma, Louisiana, Arizona, North Dakota, Texas, Missouri, Arkansas, Utah and Mississippi have passed a resolution, according to the organization Convention of States Action.

Nine other states — New Mexico, Iowa, South Dakota, Virginia, North Carolina, South Carolina, West Virginia, Wisconsin and New Hampshire — have had the resolution pass at least one chamber of their legislatures.

"I support term limits for office members of the U.S. Senate and the U.S. House of Representatives because it holds public officials accountable throughout their political careers," Riedel said. "This resolution aims to increase the opportunity for competition for new members to bring diverse ideas and experiences to reviewing and amending federal laws while providing a necessary check on the current power of the Legislative Branch.”

The alternative is to enforce the laws we already have. The Constitution we already have is sufficient. A new one could be much worse. The same folks who have done the wrong thing in the past would most likely be in charge of the new changes. Unless we change the people that we elect, nothing will change for us.

You quote pure John Birch Society bumper sticker assertions. The Framers’ design didn't rely on the virtue of elected officials.

Oh, and We the People reelected President Trump, yet somewhow, he isn't President.

So you are fine with the rat achievements I outlined in post #35?

Your reading comprehension is diminished and you’ve tried to pick a fight with someone who cares less what a wet brain Kool-Aid drinking advocate has to say about the COS. Read what I said, I am not a lawyer nor did I stay at the Holiday Inn Express last night, I don’t know how it will get hijacked, but I do know that we as as a collective society cannot run a clean election and yet they and you want a COS.

I expect if the Western Alliance of Governors said we’ll push the COS thru our legislatures but in return we want UN or Chinese observers at the Convention the COS’ advocacy would undoubtedly think that’s a great idea too. Unbelievable.

...The Constitution we already have is sufficient. A new one could be much worse.

I was wondering when someone would post this canard. It's as if Article V was slipped in by some sneaky Communist just waiting for their chance to spring their trap. Hello? Article V is IN the Constitution for the very reason we face today : a totally out of control centralized government.

The COS under consideration self destructs if it goes out of bounds. That makes any deviation from its intention impossible to enforce, too many people would be aware of that scam. At its worst it would be little different from where we are today with the left censoring the commanding heights of information and stealing our elections. As I will repeat, as often as necessary, to those with brain matter denser than neutron stars , WE HAVE NOTHING LEFT TO LOSE.

Apologies for missing your earlier post...I am not opposed to a COS, when voting makes state legislators honest conservatives; and circumstances make it necessary and possible--e.g. backlash from SCOTUS packing, creating liberal new states.

Bypassing Congress comes after electing honest state legislators; and that comes after cleaning up the electoral process.

Roberts Rules: No rule can be suspended if the negative vote is as large as the minority the rule was intended to protect.

Parliamentarian: The nomination filibuster protects minorities in the Senate of size 41 or larger. It cannot be ended unless 60 senators support doing so.

Harry Reid: The parliamentarian’s point is not well taken. We’ve got 57 votes, and majority is enough.

agreed no mater how bad it is we do not want to do a convention of states at this time in history. everything those wanting a convention of states can be done by amendments to the constitution it just is a lot harder to do in this way and that is actually a good thing becouse tweaking the constitution is dangerous. having a convention of states is 1000 times more dangerous.

This is and has always been a legitimate option.
