I think it is very important to balance the end of qualified immunity with loser pays legal reform to nip nuisance lawsuits in the bud. That way, government employees are encouraged to be circumspect in doing their jobs and citizens will find that spurious lawsuits are not a cash cow.

I think that it is the first time a Federal Court has ruled such behavior illegal, and given officers notice that may not do such, unless plaintiff's counsel missed a prior case so holding. Under the current law, in the absence of such notice, the officers are entitled to qualified immunity.
