Outgoing Senate Majority Leader Mitch McConnell (R-Ky.) on Friday circulated to colleagues a memo outlining the procedure for holding another trial for President Trump if the House impeaches him for a second time in just over a year.
The document, which was first reported by The Washington Post, lays out how the Senate would proceed if the House approves articles of impeachment and transmits them to the upper chamber before or by Jan. 19, when senators are scheduled to resume regular business after the January recess.

Well, yes. The headline is an absolute joke that is twisting McConnell’s intent on its head.
McConnell’s memo pointed out that a trial could not be held in the time left. He was pointing out that it wasn’t going to and couldn’t happen given Senate rules and the calendar. Anyone who actually read it — and who had an ounce of intelligence — would know that.
The people who are interpreting this as McConnell advocating impeachment are either lazy, stupid, or liars. Which unfortunately appears to cover about 3/4 of the posters in this thread.
No wonder we’re losing to the left. We’re apparently too dumb to actually read the things upon which we’re commenting.

The Dems are afraid that the military investigation into international interference with the Presidential Election will become public. In particular there is now legal action beoing taken against Dominion agents in Naples.
The inauguration may actually be postponed way into March , depending on what happens.

I don’t think he’s delaying anything. The Senate already agreed to pro for a sessions until 1/19, and the memo just explains that no business could happen before then without unanimous consent under Senate rules, and that also under Senate rules trial begins the day after the impeachment articles are received. It seemed, unless I’m mistaken, that McConnell is proposing changing that rule so it can happen the same day.
But either way, any delay isn’t being caused by McConnell as far as I can tell.
By the way, if I was the President’s lawyer and the impeachment trial proceeds after he has left office, I would advise him to file suit (perhaps for a writ of mandamus or habeas corpus—I’d have to think more about the appropriate remedy) asserting that impeachment of a non-officeholder constitutes an unconstitutional bill of attainder.

Both Mike Flynn and Sydney Powell know whats going on, and so far very little is being said.Or they are being prevented from speaking about it.Both Flynn and Powell have been denied entry to speak with the President which is weird.
But it is my conclusion that this situation being investigated in Italy is what is driving the Dems crazy. They can still lose it all.
How can they impeach him when he will be out of office in a few days??????

Over 80 years ago, a handful of Dutch communists set the German legislature’s building on fire. The building was gutted. I saw absolutely nothing in that memo proposing a change in rules to permit proceedings to start that same day. Nor is there any chance that a trial would be completed in one day in any case.
This is McConnell telling everyone that Trp.is not going to be impeached and removed, period.
I think you are right and I misread the article. I would like to have read the memo itself, I don’t see where it might be available.
I don’t know that it’s a given that the proceedings end with the expiration of Trump’s term, however. The Constitution allows not only removal but disqualification from further office, so the proceeding would not be moot just because he is no longer President. Historically, proceedings have not automatically ended when the impeached individual leaves office, and the Senate—from the first time this happened in 1797 to the most recent in 2009–has always expressly taken the position that it still has jurisdiction even after the impeached leaves office.
No one has ever been convicted after leaving office, so no one has ever had a need or standing to challenge the Senate’s view in court. William Belknap came the closest because the trial actually went to a verdict, but he was acquitted. There may be a good argument that, once the impeached is no longer an officer, the proceeding is no longer an impeachment trial but rather an unconstitutional bill of attainder.
The failed impeachment and then attainder and execution of the Earl of Stafford in 1640 was well known to the Founders and informed the prohibition of bills of attainder in the Constitution. There, the House of Lords was not able to impeach Stafford under the strict grounds required at the time (impeachment was only available for statutorily-defined high treason), so decided to use its power to attaint Stafford instead. It continued the trial of Stafford as though it were a judicial proceeding, even though attainder is actually a legislative function.
It might be a bit of an academic argument, but Trump might need it if the Senate decides to try him after he leaves office.

he will always be an impeached president. It's a label he will have for the rest of his life.
their goal this time, is to make him the only twice impeached president in history. They will have the vote done probably by this coming Friday.
