Judge Emmet Sullivan still refusing to dismiss Michael Flynn case
More than a week after Flynn was pardoned by President Trump, Judge Sullivan still won't dismiss the case

n a Freedom of Information case related to former National Security Adviser Michael Flynn, District Judge Reggie Walton said on Friday that Judge Emmet Sullivan doesn’t have a lot of options in dealing with the fact that President Trump granted Flynn a full pardon, “unless he takes the position that the wording of the pardon is too broad, in that it provides protections beyond the date of the pardon.”

“I don’t know what impact that would have, what decision he would make, if he makes that determination that the pardon of Mr. Flynn is for a period that the law does not permit,” said Walton, according to the National Law Journal. “I don’t know if that’s correct or not,” the judge continued. “Theoretically, the decision could be reached because the wording in the pardon seems to be very, very broad. It could be construed, I think, as extending protections against criminal prosecutions after the date the pardon was issued. I don’t know if Judge Sullivan will make that determination or not,” Walton added.

...

The legal process has dragged on through the appeals process, and finally President Trump issued a full pardon on November 25. On November 30, the DOJ notified Sullivan of the pardon, but he has still refused to drop the case.

Judge Walton appears to have hinted at what Sullivan is thinking as he refuses to dismiss the case.

Solomon Wisenberg, former deputy independent counsel, told Just the News that “It is disappointing but not surprising that Sullivan has yet to dismiss the case.”

When Republicans take the House in ‘22, impeaching Sullivan should be on the agenda

Do you envision having 67 votes in the Senate to remove Judge Sullivan?

I sincerely believe Sullivan, having taken on the role of judge and prosecutor, is mentally unbalanced

He's a good soldier and he's showing great fidelity to whomever he's getting his orders from.

He's not unbalanced in the least.

The Sullivan phenomenon simply shines a light on how organized this conspiracy is and how well-hidden the leadership is.

Maybe Sullivan is hoping a new DOJ will find new charges or something

Not in that term, certainly. It doesn’t mean they shouldn’t do it anyway.

Barr should have already prosecuted this misfit out of control judge.

Takes a House vote to impeach...

Only 8 Federal Judges have been impeached in all Federal history.

Judge Porteous was the last one.

In his defense, as his ‘character witness’, the Judges attorney brought in Disgraced State Judge Bodenheimer ... who had just completed a three year term in the pen... even the corrupt democrat Senators were shocked.

I’m aware of what you seem to believe is indicated by the 2020 election, but it’s nonsense. There will be an election in 2022 and Republicans will win it so long as too many Republican voters aren’t still chasing their tails by then.

He isn’t brain dead, he is a domestic enemy. It is important to differentiate between acts of stupidity and acts of malice, and respond accordingly.

“Except for all the elections they won this year.”

Not all democrats were on board, but they will be. The communist found there isn’t sh*t anyone will do if they get caught red handed stuffing ballot boxes.

The Georgia senate seats are a key example of this. The ONLY reason there is a runoff is that the communists stuffed the ballot boxes but just not by enough. They won’t make that mistake again.

As a complete aside, I find it amusing that you hardly ever see Sullivan referred to by “Reagan appointed Judge...”

I think the guy is just being a jerk for some personal reason—not sure if Flynn insulted him personally, or if one of his lawyers did. But it is an example of the amount of power vested in our Judges.

I’ll say they didn’t stuff it enough. Almost a million votes short in the case of Warnock, and over 100,000 short for Ossof. Makes one wonder why the Democrats stuffing the ballot boxes with Biden didn’t just mark them for Ossof as well.

Sullivan was appointed to his current bench by Clinton. Reagan and Bush appointed him to the DC Superior Court and DC Court of Appeals, respectively, which are analogous to state courts for DC. It wouldn’t be remarkable for Reagan or Bush to appoint a liberal to those benches, at least by the norms of the time, so I wouldn’t read much political content into the Reagan appointment.

It may indeed be personal, but I wouldn’t rule out political motivation, either. The DC Circuit en banc ruling denying mandamus relief and refusing to order Sullivan’s recusal earlier this year was certainly a party-line vote.

No one betrayed anyone. If you want to stay home and sulk because winning elections is too hard, that’s your problem.
